    Florida Proposing A Tax Most Are Calling Ridiculous

    Tallahassee, Florida –Florida legislators preach lower taxes and more job creation for Florida residents, but are they really looking out for your interest?

    As the 2014 state legislative season opens and states continue the never ending quest for new tax revenues, a large number of legislative proposals have been made to continue the recent trend of increasing the scope and broadness of the sales tax nexus to include any “affiliate partner” of a business or corporation. The tax is commonly known as the “Amazon Tax” or “Internet Tax,” but legislators in many states felt it would be easier to sneak the bill in under the radar by naming it the “Nexus Tax.” The tax is confusing, complex and is meant to directly target “affiliate partners.”

    Right now, at least 13 states (Florida, Hawaii, Indiana, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, New Mexico, Oklahoma, Utah and West Virginia) have proposals currently being considered which would expand nexus for sales tax purposes to the extent that it will crush many businesses within those states.

    The sales tax is designed to line the pockets of the state by indirectly stealing from the pockets of small businesses and individual affiliate partners of larger businesses.

    While these proposals all vary slightly, the proposal in Florida appears to be a model of the form of such proposals. Briefly, the Florida proposal (S.B. 316) would make the following changes:

    Modify definition of “Mail Order Sale” or “Internet Sale” to include sales of tangible personal property made via the internet.

    Require dealers who have nexus in Florida and meet one other factual characteristic to register and collect sales and use taxes. These factors include (this is not an exhaustive list): (a) Maintaining an office distribution facility, warehouse storage facility or other location to facilitate the delivery of property or services sold by the dealer; (b) Using trademarks, service marks, or trade names in Florida; or (c) Delivering, servicing, or installing the product in Florida. This includes any and all Affiliate Partners whom reside in Florida, but strictly sell on the internet by way of “Affiliate Websites” or “Affiliate Links” on websites such as business blogs, mom blogs, dad blogs and some media websites. However, “Affiliate Links” are also known to be associated with companies like Best Buy or Sears.

    If you have visited a retail website and have ever seen a product listed under “Market Place,” most likely it is an affiliate link.

    The bill will Impose a click-through nexus provision which establishes a rebuttable presumption of nexus if a dealer enters into an arrangement with a Florida resident whereby the Florida resident refers or links potential customers to the dealer’s website for a commission or other form of compensation.

    Chances are you probably know someone who is an affiliate of a business or corporation. Florida is one the largest in terms of residents and small businesses that are engaged in some fashion of business affiliation, namely stay at home moms.

    If passed, the bill will devastate small businesses and individuals who run small profit, to very profitable affiliate businesses online.

    Amazon, the worldwide leader in affiliate partnerships, announced it will drop all of its affiliate partners whom reside in Florida if the bill passes. And Amazon is quite serious with their threats as the corporation dropped thousands of its affiliates in Connecticut and Arkansas after both states passed a similar law.

    Amazon said no way, and referred to the 1992 Supreme Court decision that ruled that states cannot require companies to collect such taxes if they don’t have a physical presence in the state. But with states across the country facing major budget shortfalls, officials are moving aggressively to try and force Amazon, as well as multiple other corporations to collect the taxes by arguing that the company has in-state presence through distribution centers or local “affiliate partners.”

    Florida has more residents and small businesses that are “affiliate partners” of other corporations than Connecticut and Arkansas combined. Affiliate partnerships is a big business and generates billions of dollars for affiliates every year; depending on how hard a person markets themselves.And while some stay at home moms can earn a substantial salary, many moms, as an affiliate, may earn considerably less, but it may be just enough to get that family by while dad works full time for minimum wage.

    “Obamacare” is estimated to put 1.2 million more people out of work by the year 2017, if the amended “nexus bill” is passed, that number will be even greater.

    Legislators are refusing to look at the big picture, and seem to be solely concerned with making their pockets fatter while stepping on the little guy.

    Analyst say that legislators in Florida clearly have their own agenda in this situation. They are trying to profit off of companies they know are financially stable, the government is showing its true level of greed, said one tax attorney. Most tax experts are calling the nexus tax ridiculous and unfounded.

    The bill is presently pending. Taxpayers in Florida and any of the other states currently considering such laws should closely monitor these proposals in order to insure that the proper compliance processes and systems are ready in the event that any or all of these bills become law. Most importantly, Florida residents should also refer to the 1992 Florida Supreme Court decision.

    E-mails from Ocala Post to the senate went unanswered.

    Belleview Man Arrested In Massachusetts

    Belleview, Florida — Mark Anthony Bryant, 31, of Burlington, Massachusetts, has been charged with having inappropriate contact with a juvenile.

    Detectives interviewed the victim who said the sexual contact with Bryant happened during a 2-year period, from the age of six until she was eight, in Belleview, Florida.

    Bryant left Marion County and was later tracked down in Massachusetts.

    Bryant was arrested in July of 2009 on an outstanding warrant out of Martin County for Lewd and Lascivious Exhibition using a computer on a child under 16. He was already on probation at the time of his arrest. He was released in January of 2010.

    In October of 2012 Bryant was arrested again for trying to avoid the Sex Offender Registry. He was released in March of 2013.

    Bryant was arrested on March 2, 2014 and is now being held at the Marion County Jail without bond.

    The Marion County Sheriff’s Office is asking for the public’s help. Detectives would like to know if anyone knows about Bryant’s contact with children.

    Extreme speed was factor; car ripped in half

    Polk County, Florida — At approximately 12:48 am, on Monday, March 03, 2014, Davenport and Haines City Police were investigating a suspicious person on US 17/92 and North Boulevard, Davenport.

    As they were conducting their investigation, a white Nissan Altima, driven by 49-year-old Karen Reynolds Johnson, of St. Cloud, passed them at a high rate of speed traveling southbound on US 17/92.

    Police said Johnson almost struck their patrol cars on the side of the roadway as she sped by. Haines City units attempted to catch up to and locate the vehicle, but were unsuccessful.

    At 1:10 a.m., the PCSO Emergency Communications Center received a report of a crash at Davenport Boulevard and Old Holly Hill Road, Davenport.

    A responding Davenport Police Officer located the crash which involved Johnson’s Altima. The vehicle was badly mangled, had been torn in half and Johnson had been ejected as a result of the crash. The Davenport Officer attempted CPR on the victim until Fire and Medical units arrived on scene. Fire and Medical officials determined Johnson was deceased on the scene.

    Davenport Police requested assistance from the Sheriff’s Office. Polk County Traffic Homicide deputies responded and began investigating. According to reports, evidence at the scene indicated the Nissan was eastbound on Davenport Boulevard (CR 547) at an extremely dangerous high rate of speed.

    Investigators determined that as Johnson entered a left curve near Old Holly Hill Road, she left the south (right) side of the roadway. Johnson attempted to recover, but the vehicle began to rotate counter-clockwise across the grass shoulder. The vehicle struck a drainage culvert on the southwest corner of Old Holly Hill Road causing the vehicle to be launched into the air. The vehicle continued airborne across Old Holly Hill Road in a southeasterly direction. It crossed Old Holly Hill Road approximately ten feet in the air and traveled approximately 200 feet airborne, until striking a tree fifteen feet up from the base.

    The impact of the collision with the tree was so forceful it ripped the vehicle in half as it continued southeast another thirty feet where pieces of the car struck two more trees. Johnson was seat belted, but the damage to the vehicle was so severe she was ejected and came to rest about ten feet south of the front piece of the car.

    Speed was a major factor in this crash. Impairment and distracted driving do not appear to be factors at this time.

    Davenport Boulevard was closed for approximately four hours.

    The investigation is on-going.

    Wheel Breaks Free From Car; Kills One, Injures Another

    Williston, Florida — According to Williston Police, a wheel broke free from a car and killed an man early this Monday morning, March 2, 2014.

    Police said that it was first believed that a tire compressor had exploded and killed the man, but that later proved to be false.

    Investigations revealed that Patrick Woodard of Gainesville was driving north on U.S. 41 in a 1999 Toyota at around 9 a.m. As the vehicle approached the Absolute Auto Body shop at 104 NW 10th Avenue, the left front tire broke free from his car and flew north on the west shoulder of the highway.

    The tire then hit a driveway apron with such force, it became airborne. It then cleared a 6-foot-tall metal fence and struck Ivan J. Sandquist, 33, of Williston, killing him instantly, according to police.

    After striking Sandquist the tire then hit James E. Fender, 45, of Williston. He was airlifted to UF Health Shands Hospital with serious injuries, according to reports..

    Williston Police said they were assisted at the scene by the Levy County Sheriff’s Office crime scene unit and the Florida Highway Patrol.

    Police said the investigation into the accident is still ongoing at this time, and they do not have a cause as to why the wheel broke free from the moving car.

    Police investigate a bizarre case of strong-arm robbery

     

    Ocala RobberyOcala, Florida — On March 2, 2014 Ocala Police Officer K. Drawdy responded to MRMC in response to a late reported assault.

    Officer Drawdy met with two individuals whom said the victim had been involved in an altercation with several black males on Saturday, March 1, 2014, in the parking lot of Spring Manor Apartments.

    The victim, whom was incoherent at the time of Officer Dradys’ visit was not able to provide a statement.

    The two individuals stated that they were with the victim along with another person, downtown when the three of them decided to go to Spring Manor to get water for their car because it was overheating.

    They said shortly after they arrived at Spring Manor the victim was involved in an altercation. They said the victim was on the ground bleeding from his nose and ear, and he had been stripped down to his boxers; all other personal items were taken.

    The suspects stole the victims blue jeans, sneakers, wallet, watch and cell phone.

    After the assault the victim refused to go to the hospital, however the next morning he was unable to speak. It was at that time the victim was taken to the MRMC.

    According to reports, medical staff informed Officer Drawdy that when the victim arrived he was barely conscious, and could only mumble that he had been hit in the head.

    The two individuals that were with the victim told Officer Drawdy that they could not provide details of the location where the incident actually happened nor a description of the suspects.

    Through investigation, officer Drawdy determined that the incident happened in front of an apartment in Spring Manor.

    Officer Drawdy has not been able to obtain a statement from the victim or the other individual that was with the victim on the day of the incident.

    The investigation is ongoing.

    Search Called Off For John Radabaugh Jr.

    John Radabaugh Jr. went missing on February 25, 2014, while he and his father were raking leaves at their residence. His father went inside to answer the phone and when he returned, Radabaugh Jr. was gone.

    With a large portion of the community being involved, the Marion County Sheriff’s Office organized a search for Radabaugh Jr. that took place for five days. Volunteers turned up by the dozens and right along the side of law enforcement, they left no stone un-turned. On Saturday alone, more than 150 people were involved in the search including law enforcement, fire officials and volunteers.

    John Radabaugh Jr. is still missing. Tonight, Lieutenant Mcfatten, with the Marion County Sheriff’s Office told Ocala Post that they have spoken with the family of Radabaugh Jr. and explained that the sheriff’s office has exhausted all of their resources. Mcfatten said, “I urge the community to stay involved and if someone were to find a shoe, shirt or any other item that would produce a lead, of course we would resume the search at that time.” Adding, “The family understands.

    Step mom Kim Fairless Boyer Agents wrote, “I am 110% Happy with the Marion County Sheriff’s Office and all their staff that was involved in this search.” She is now asking for the community to stay involved and search in every shed, tree house or outdoor building in the area of 19455 SE 91st Place in Ocklawaha, where Radabaugh Jr. went missing.

    3 women severely beat a girl after school meeting

    Deltona, Florida — Three women were arrested for child abuse Friday after slapping, kicking, and choking a teen girl and then forcing her to take her clothes off so they could beat her with belts.

    The women said they were disciplining the girl because she had been suspended from school.

    Volusia County sheriff’s deputies responded to the Deltona home after an anonymous caller reported seeing the three women chasing the teen outside.

    Shortly after noon, a caller reported a disturbance in the 500-block of Pemberton Avenue. The caller said three women were chasing and fighting a girl and they had all gone into a nearby house. When deputies arrived, they found the victim upset and crying in the home while wearing just a bra and panties. She had multiple bleeding cuts and severe welts all over her body.

    Deputies reported that Ishiyah McGhee, 30, and Janine McGhee, 39, were also in the home. They were standing in the home holding belts and breathing heavily. A third woman, Moriyah McGhee, 32, was also involved in the incident, but was not at the scene when deputies arrived.

    The teen was transported to the hospital while deputies investigated the incident. The 14-year-old girl was transported by EVAC ambulance to Florida Hospital Fish Memorial, Orange City, to be treated for multiple lacerations and severe welts. The girl was then turned over to the custody of the Florida Department of Children and Families.

    Deputies learned that the girl (victim) and the three women had been to the girl’s school that morning for a meeting about the teen’s suspension. When the meeting was over, they all walked to the parking lot and the teen said that’s when the beating started. The women slapped the victim, shoved her against cars, and choked her by grabbing her necklace. They all then got into vehicles and left the school.

    As they got close to the Pemberton Avenue house, the girl said she had jumped out of the vehicle and started running away so as to avoid further physical violence. According to reports, the women chased her and grabbed her by the hood of her sweatshirt, choking her. They then forced the victim into the house.

    Once inside, Janine McGhee demanded that she and the victim fight, but the teen refused. The victim told deputies that the women then forced her to take her clothes off so that she would feel the pain. The women then repeatedly kicked, punched, and beat the victim with belts over her entire body until deputies arrived.

    Janine, a Daytona Beach resident, and Ishiyah, a Deltona resident, were arrested at the scene for child abuse and taken to jail. Moriyah, a Deltona resident, turned herself in to deputies. She was also charged with child abuse and taken to jail.

    The relationship between the girl and the three women cannot be released in order to protect the victim’s identity. Investigators said they are looking into whether or not child abuse has been an ongoing situation in the home.

    All three women claimed they were only disciplining the girl and said they don’t feel they did anything wrong. Deputies said the women were more than happy to smile for their booking photos.

    Bomb threat locks down Marion County school

    Bomb threat, marion county, ocala newsOcala, Florida –Today, February 28, 2014, while serving as the School Resource Officer at Silver River Mentoring and Institution (SRMI), Officer Green with the Ocala Police Department was notified by the school’s Executive Director, Mike Nebesnyk, in reference to a note found on the hallway floor during bus offloads.

    The note indicated that there was a bomb on a bus.

    The note read (as it was worded), “There a bomb on one of these buses and if not found it will go off in 20 minutes and you will die.”

    The school was placed on lockdown, and all of the buses were relocated to Shocker Park, which is located across the street from the school.

    Officer Green notified OPD Communications and additional units were dispatched to the scene. The Marion County Sheriff’s Office K-9 Bomb Detection Unit was also called in to work the scene.

    School Dean Greg Vandeventer, pulled surveillance videos from the school and was able to identify David Doughty, 13, of Ocala. Doughty stated that he gave a piece of paper to another student, Christopher Carter, 14, to write the note.

    Security footage from Doughty’s bus showed [him] giving a piece of paper and a colored pencil to Carter. Carter then used a binder belonging to Jeremi Jensen, 13, to write the note; Jensen and Carter were sharing a seat on the bus.

    Surveillance footage showed Carter, Jensen and Doughty reading the note, then discussing where to drop it.

    The trio then passed the note to Tavares Bokyin, 14, before getting off the bus. Boykin dropped the note on the floor as he entered the building.

    The buses were searched and cleared, but the school halted, breakfast was delayed, the off campus trip was canceled and all activity at the school ceased as a result of the actions of the four boys.

    Doughty, Carter, Jensen and Boykin were all arrested and transported to the Marion County Sheriff’s Office Juvenile Processing center where they will be charged as felons.

    Known Prostitute From Local Motel Arrested On Different Charges

    Ocala, Florida — Today, February 28, 2014, Deputy William Blair was conducting a security check at the Stevens Motel on South Pine Avenue when he came into contact with known prostitute, Mary Wise, 30, of Ocala.

    Wise is a resident at the Stevens Motel.

    As Deputy Blair was standing in front of Wise’s room speaking with her she opened the door to her motel room, at which time the deputy saw a suspicious unmarked pill bottle on the bed.

    While the deputy was talking to Wise she invited him to enter the motel room, at which time Deputy Blair could clearly see that the pill bottle did not contain pills; it actually contained what appeared to be Crack Cocaine, according to reports.

    Deputy Blair also noted that right next to the pill bottle was a clear plastic baggie containing a green leafy substance that appeared to be marijuana. And as Deputy Blair looked closer, he said he saw another small white plastic bottle that also contained a white rock substance.

    Deputy Blair collected the evidence and field tested it at the scene. The white rocks tested positive for Cocaine, and the green leafy substance tested positive for marijuana.

    According to reports, there were six pieces of Crack Cocaine in the small white plastic bottle, and 148 pieces of Crack Cocaine in the unmarked pill bottle.

    After obtaining written consent to search the room, Deputy Blair found a “glass stem crack pipe” hiding in the curtains and eight more pieces of Crack Cocaine in the nightstand drawer, for a total of 162 pieces of Crack Cocaine.

    Wise was arrested and transported to the Marion County Jail.

    She was charged with Possession of Cocaine with the Intent to Distribute, Possession of Marijuana, and Possession of Drug Paraphernalia.

    Wise was out of jail on bond after being arrested on February 6, 2014, for soliciting an undercover OPD officer for sex.

    Wise is currently being held on a $11,000 bond.

    Search For John Radabaugh Of Ocklawaha Continues

    Ocklawaha, Florida — The Marion County Sheriff’s Office and numerous volunteers spent today searching for a missing Ocklawaha man that was last seen on February 25, 2014. Today’s search ended with zero results.

    The Sheriff’s Office said more than 70 professionals and volunteers participated in today’s search, and the search will resume at 8 a.m., Friday, February 28, 2014 at the Moss Bluff Baptist Church.

    Tonight, a reverse 911 system was activated to contact and alert residents within a 40 miles radius of John Radabaugh’s home.

    The Marion County Sheriff’s Office, as well as family and friends said they are concerned about the temperatures dipping into the 30’s tonight and were really hoping today would produce better results. Marion County Sheriff’s spokesperson Judge Cochran said there is a since of urgency among everyone that has come together to search for Radabaugh.

    The family said they fear that someone could use Radabaugh’s child like mannerisms against him. Radabaugh’s step mom said, “If anybody offered him candy or a toy he would go in their home, that’s a big fear of mine.” Adding, “Somebody who is not for the right thing may have him. So if you have him please let him go.”

    Former Frances Marion Military Academy teacher, Duane Adams had second victim

    Ocala, Florida — A second juvenile has been identified as a victim of former Frances Marion Military Academy Teacher, Duane Adams.

    In the course of the investigation against Adams, investigators learned that during the last school year there had been a fight between two girls and that the girls were actually fighting over Adams. The fight took place after the girls found out that Adams had been sending each of them text messages that were sexual in nature. Investigators located the two girls and identified the second victim.

    The victim said she got into a fight with the other girl because [she] felt she had spread rumors about she and Adams.

    The victim was interviewed on February 25, 2014, by Victoria Smith at the Kimberly’s Center. The victim stated that she went to Francis Marion Military Academy her freshman and sophomore years. She told Smith that shortly after [she] enrolled at FMMA, she joined the Orienteering team and the Raiders team. Adams, at that time, was the coach for the Orienteering team.

    The victim said that Adams treated her differently from other students and it was apparent that she was being given more attention. [She] said when the team would go to Orienteering meets Adams would have her ride up front with him, even when there were seats available in other vehicles or in the back seat of Adams’ vehicle.

    On “dress-down” days Adams would compliment her on the way she looked, and on one occasion told her he was attracted to black girls, according to the victim.

    The victim said that Adams began to text her, and that the text messages became increasingly sexual in nature. [She] said at one point Adams gave her $100, in $20 bills just because she was his “second girlfriend.”

    She told investigators that on Valentine’s day of 2012, Adams brought her a box of chocolates.

    She said during school Adams would text her to meet him in his classroom, and she would leave class to meet him. During the alone time in his classroom, the victims said Adams would tell her she was pretty and they would sit on a sofa in his classroom. She said eventually the meetings turned into kissing and touching. In one instance, she said she met Adams in his classroom during school hours and when they were kissing, Adams touched her vagina over her clothing. She said he then asked her to suck his penis as he exposed it to her. The victim stated that she refused to do so, at which point he stopped, kissed her again and sent her back to class. She said Adams would write her a pass to return to class after meeting with him.

    The victims said the sexual text messages continued, and the two eventually went to a local motel together.

    She said earlier in the day, before arriving at the motel, Adams had walked by her and said, “I want to ‘F’ you hard.” That afternoon, she said, he was to driver her to Raiders practice at the Marion County Sheriff’s Office obstacle course, but instead Adams drove her to the Howard Johnson motel on NW Blitchton Road.

    She said once inside the motel room they danced and started undressing, and once they were both completely naked they got into the bed.

    She said her and Adams had sex and he ejaculated. She said Adams did not wear a condom and he told her he could not get her pregnant because he had gone through “menopause.”

    It was confirmed during the previous investigation, by Adams’ ex-wife, that Adams had a vasectomy.

    Investigators confirmed that a room was rented at the Howard Johnson in Adams’ name with his telephone number. The vehicle information documented on the reservation matched a car that belonged to his wife. (Now ex-wife)

    The victim went on to describe another event that took place one day after school at the old FMMA campus, in Adams’ classroom. She said she went to his classroom and he locked the door and said he was horny. The victim said she knew this meant he wanted sex. She said she told him no, but he insisted. She said she got on a blue sofa with her pants down, but not off. She stated that Adams had sex with her from behind, and he did “finish.” She said he kept looking out the window because people were still on campus.

    Evidence Technician Brenda Yanik, using an ultraviolet light, got a positive match off of the couch (which had been moved to his new office) for bodily fluids. The cushion covers were removed and sent off for DNA analysis.

    Duane Adams has been charged with Sexual Battery- Penetration of the Victims Vagina by the Defendants Penis on a Child Over 12-years-old but Under the Age of 18, While in the Position of Familial or Custodial Authority to the Victim. Florida statute 794.011(8)(b).

    Among this newest charge, Adams has 25 other charges against him to include Lewd and Lascivious Battery on a Child and Interference with Child Custody stemming from the previous investigation.

    Ocklawaha Resident John R. Radabaugh Jr Still Missing

    Ocklawaha, Florida — At this time, The Marion County Sheriff’s Office does not have any updates on Radabaugh Jr, whom has been missing since February 25, 2014.

    The sheriff’s office field force team will return to the area Thursday, February 27, 2014 to continue their search.

    BB gun shooting suspects charged in $22K crime spree

    Marion County, Florida — Marion County Sheriff’s Office detectives, using a tip from Crime Stoppers, were able to build a case against four adults who are now charged with a spree of BB gun shootings in Marion County.

    The four suspects, known as the “BB Gun Bandits,” are all from Weirsdale, they are accused of shooting and damaging 55 vehicles and a window at a U.S. Post Office. Early estimates put the cost at more than $22,000 for victims.

    Arrested were: Austin Terrence Fagan, 19, Shane Allan Partain, 18, Kameron Colby Cole, 22, and Kaitlin Alexis Prusansky, 18.

    The tip came in Tuesday, February 25, 2014, and detectives tracked down the suspects Wednesday, February 26, 2014. Detectives interviewed each suspect, who confessed to the crimes. The suspects told detectives that they committed the crimes because they were bored.

    Detectives indicated that they were able to collect all four (4) BB guns as evidence.

    While being held at a Marion County Sheriff’s Office District Office, the suspects were interviewed by several other law enforcement agencies from nearby counties and cities.

    Detectives said the four suspects, each, could soon face more than 100 criminal charges.

    If convicted, all four suspects could possibly be ordered to pay restitution for all damages, to all victims involved.

    A list of charges for each individual was not immediately available.

    Suspects In Recent BB Gun Shootings In Custody

    Ocala, Florida — Investigators now have in custody….Four (4) adults who are top suspects in the recent rash of BB gun shootings that resulted in thousands of dollars in damages to vehicles. The suspects are being interviewed by investigators from multiple law enforcement agencies at the Marion County Sheriff’s Office South Central District Office, 3260 SE 80th Street, Ocala, FL.

    This crime spree took place from 2 p.m., Friday, February 21, 2014 through 10 a.m., Saturday, February 22, 2014 in neighborhoods from Ocklawaha to Belleview to Silver Springs Shores to the Forest community, and again the following day.

    More than two dozen vehicles were damaged as well as windows to a post office. Each incident had similar elements: a window was damaged by someone shooting a BB gun at the vehicle. The vehicles were SUV’s, cars, pickup trucks and vans. The attacks were on side and back windows or front windshields.

    The three males and one female range in age 18-20 years old.

    More information will be released as the investigation continues.

    Orlando, Florida – The Florida Department of Law Enforcement Orlando Regional Operations Center arrested Daryl Ali, 31, on one count of organized scheme to defraud and one count of money laundering.

    Investigators believe Ali used information from existing businesses to set up fraudulent merchant accounts. With the fraudulent accounts, Ali processed nonexistent merchandise returns in order to steal money from credit card companies. Once a credit card company refunded money back to the fraudulent business, Ali immediately moved the refunded money to a stored value card or withdrew the cash.

    “Thanks to the Florida Department of Law Enforcement’s investigative efforts, Ali is being held responsible for his alleged fraudulent scam in which he illegally netted $500,000 in a matter of months,” stated Attorney General Pam Bondi. “My Office of Statewide Prosecution will prosecute Ali for organized scheme to defraud and money laundering.”

    This was an usually complex investigation and I appreciate the dedication of the agents that solved the case,” said FDLE Commissioner Gerald Bailey.

    The investigation began in July 2013 after FDLE received a complaint from American Express.

    Ocala, Florida — On February 23, 2014, deputies responded to the 5600 block of NE 22nd Avenue in reference to a 911 call involving domestic violence.

    Upon arrival, Deputy Daniel Jones, made contact with a gentleman whom told Deputy Jones that [his] ex-wife, Renee A. Phillips, 39, tried to slit his throat.

    The man said he was sitting in the garage when his ex-wife came up behind him, grabbed him by the neck with one hand, and placed a knife to his throat with the other. The man said when he turned to look at his ex-wife she dropped the knife and ran into the kitchen.

    A short time later, the man said he was standing in the kitchen when Phillips again came up behind him and placed a different knife to his throat, and said, “I’m going to kill you.” At which point the man grabbed her wrist, forcing her to remove the knife from his throat.

    Concerned for his own safety, he dialed 911.

    The man told Deputy Jones that each time she put the knife to him, he could feel the steel blade pressing against his throat.

    The man stated that his ex-wife had been accusing him all day of “drugging her.”

    While Deputy Jones was questioning Phillips, she said that she was not “feeling herself,” and she believed her ex-husband had been “drugging her.” She said, “I don’t feel normal.”

    Phillips denied putting a knife to her ex-husband’s throat. However, the man had injuries consistent with having a blade pressed to his throat and there was also fresh blood on the man’s neck, along with finger nail marks, according to reports.

    Phillips was arrested and transported to the Marion County Jail. She was charged with Aggravated Domestic Battery with a Deadly Weapon.

    Deputy Jones later determined Phillips had been drinking throughout the day.

    Polk County, Florida — On Friday, February 21, 2014, Polk County Sheriff’s undercover detectives conducted a Vice initiative at Saddle Creek Park in Lakeland, focusing on complaints about indecent activity at the park. A total of nine men were arrested for soliciting lewd acts.

    60-year-old Stephen Cyr, of 3305 Skyview Drive #105 in Lakeland, solicited an undercover detective to commit a lewd act. Cyr told detectives he is a roofer for Springer Peterson. He is a Registered Sexual Predator from a case in Hillsborough County in 1997 and has been in the Polk County Jail on three prior occasions, between 2009 and 2011, for DUI, and VOP. He was arrested and charged with Soliciting Another to Commit a Lewd Act. He was booked into the Polk County Jail and has been released after posting $250.00 bond.

    68-year-old Fred Keith of 226 Esther Street in Lakeland, solicited an undercover detective to commit a lewd act. He told detectives he is retired from Dupont. He was arrested and charged with Soliciting Another to Commit a Lewd Act. He was booked into the Polk County Jail and has been released after posting $250.00 bond.

    51-year-old David Giddens of 1545 Eagle Lake Loop Road in Eagle Lake, solicited an undercover detective to commit a lewd act. Giddens told detectives he works at Autozone. He was arrested and charged with Soliciting Another to Commit a Lewd Act. He was booked into the Polk County Jail and is being held on $250.00 bond.

    55-year-old Peter Fortier of 802 Hill Colony Circle East in Lakeland, solicited an undercover detective to commit a lewd act. Fortier attempted to flee from law enforcement when they told him he was under arrest. He was arrested and charged with Soliciting Another to Commit a Lewd Act, Resisting Arrest, and Battery on a LEO. He was booked into the Polk County Jail and has been released after posting $2250.00 bond.

    48-year-old Timothy Reed of 300 Collins Street West in Lakeland, solicited an undercover detective to commit a lewd act. Reed told detectives he is an operations manager at Bunch Care Solutions. He was arrested and charged with Soliciting Another to Commit a Lewd Act. He was booked into the Polk County Jail and has been released after posting $500.00 bond.

    70-year-old Marcel Couture of 804 Osprey Avenue in Davenport, grabbed an undercover detective and made lewd comments. He told detectives he is a driver for Disney World. He was arrested and charged with Battery. He was booked into the Polk County Jail and has been released after posting $500.00 bond.

    76-year-old Robert Lash of 3435 Crestwood Drive in Lakeland, solicited an undercover detective to commit a lewd act. Lash told detectives he sells cars at Lash Auto Sales. He was arrested and charged with Soliciting Another to Commit a Lewd Act, 3rd or Subsequent Offense, and Trespassing. He has been in the Polk County Jail on two prior occasions, in 2007 and 2012, for Exposure of Sex Organ in Public and Offering to Commit Lewdness. He was booked into the Polk County Jail and has been released after posting $1250.00 bond.

    61-year-old Thomas Bigsby of 211 Moss Road in Auburndale, solicited an undercover detective to commit a lewd act. Bigsby told detectives he is a self-employed auto mechanic. He was arrested and charged with Soliciting Another to Commit a Lewd Act. He was booked into the Polk County Jail and has been released after posting $250.00 bond.

    49-year-old David Krusyna of 1705 Branch Lane in Auburndale, solicited an undercover detective to commit a lewd act. Krusyna told detectives he is a valet at 717 Enterprises. He was arrested and charged with Soliciting Another to Commit a Lewd Act. He was booked into the Polk County Jail and is being held on $250.00 bond.

    “Polk County’s parks are beautiful places where we can relax, fish, play, and enjoy time together. They are not places for committing lewd acts or exposing yourself. If you choose to commit illegal acts in our parks, you will be arrested and booked into the Polk County Jail,” said Sheriff Grady Judd.

    Marion Oaks woman had sexual relationship with 12-year-old boy

    Marion Oaks — On February 24, 2014, a 12-year-old boy and his mother made contact with the Ocala Police Department to report that [he] had been sexually involved with a 35-year-old woman known to him as Ms. Joy, on multiple occasions.

    The woman was later identified as Joy McCall of 343 Marion Oaks Lane.

    The incident came to light after the boy told a church member about his sexual encounters, along with several text messages that were discovered. The text messages helped provide investigators with a timeline of the events.

    The boy said he began receiving Facebook messages from McCall and each message she sent became more and more heated. He said she eventually sent him pictures of herself wearing only underwear.

    On January 13, 2014, the boy said McCall sent a text message stating she wanted to meet at the Paddock Mall. The boy said he and his older brother then drove to the mall and when they arrived [he] told his brother he had to go to the restroom, at which point he met McCall outside and left with her.

    McCall then drove to the outer portion of the Belk Parking lot and parked. The boy stated he and McCall then got into the back seat of the car where McCall removed his pants. The boy told investigators she then performed oral sex on him. McCall then removed her pants and the two had sex, according to the boy.

    On January 18, 2014, McCall contacted the boy and wanted to meet again. The boy pretended to go on a bike ride, but instead, she picked him up and drove to a wooded area where the boy said they both engaged in oral sex as well as sexual intercourse.

    On February 16, 2014, the boy said she picked him up again and returned to the same wooded area where they engaged in more sexual activity.

    After questioning the boy, investigators made contact with McCall at her residents. During questioning, she did not deny her interactions with the boy. She admitted to having sex, as well as oral sex with him on multiple occasions, specifically the dates mentioned by the boy.

    McCall was arrested and transported to the Marion County Jail. She is currently being held on a $45,000 bond and has been placed on suicide watch at the jail.

    She was charged with three felony counts of Lewd and Lascivious Battery on a Child Age 12 to 16.

    McCall reportedly has two children of her own, approximately the same age as her victim.

    Florida Residents Still Can’t Afford Health Insurance

     

    obamacare, medicaid, ocala post, marion countyMarion County, Florida — A new report for Florida shows that President Obama’s promise of affordable health insurance is anything but reality, and Marion County residents are feeling the effects as local businesses began cutting work hours in August of 2013.

    Last year Ocala Post reported on Medicaid expansion and how the Florida House chose to vote against expanding Medicaid under Obama’s “Affordable Care Act” in fear it would cost the state to much money.

    The new report shows that Floridians are too poor to even qualify for the “Affordable Care Act.” Residents earning approximately $24,000 a year for a family of four are not eligible for tax credits, according to the standards set by “Obamacare.” Over one million Floridians, according to market place standards, are too poor.

    The Florida House says they do not want to cover “lazy” people, however according to the Medicaid guidelines, many residents make too much money to qualify for Medicaid. So now… not only can residents not qualify for Medicaid, they are too poor to qualify for “Obamacare.”

    Analysts said that the poor, who should be qualifying for something, will not be able to because the House chose to vote against Medicaid expansion. The lack of tax credits will prevent everyone that is living below the poverty level from being able to afford coverage. This will certainly affect pregnant women, children, the disabled and single parents.

    Vice President Jo Biden is placing the blame directly on Governor Rick Scott, while others are pointing the finger at Obama and his administration.

    Only 300,000 people in Florida have signed up with the marketplace, a far cry from the millions that President Obama was expecting.

    Biden said if Governor Rick Scott had accepted the Medicaid dollars that were offered to the state, then Florida would be in much better shape. Biden says Governor Scott can still get on board if he chooses to do so.

    Analysts are predicting that by the year 2017 there will be an additional 1.2 million people out of work as employers continue to cut work hours below 28 hours a week.

    The Obama administration fired back by stating that the reason people will be out of work is because they will choose to be, that way a person who doesn’t work can qualify for Medicaid and other government funds; completely placing the burden and the failure of ‘Obamacare” on U.S. residents.

    An e-mail to Ocala Post from the White House stated that the economy is recovering and the employment rate is up. Citing that real estate is beginning to boom because home purchases are on the rise, namely in Florida.

    However as Ocala Post pointed out in November of 2013, it is not hard working Americans that are buying homes, or businesses for that matter, it is foreigners.

    “I signed an Executive Order to raise the minimum wage to $10.10 for federal contract workers,” Obama wrote.

    “It’s the right thing to do. But what’s more, companies have found that when their employees earn more, they’re more motivated, they work harder, and they stick around longer.”

    Experts argue that raising the federal minimum wage will cripple the economy. Employers can barely afford to pay benefits to employees, much less a higher wage. McDonalds workers are demanding $15.00 an hour for asking, “Do you want fires with that?”

    Meanwhile, college graduates are working two jobs to pay back student loans because employers cannot afford to pay graduates what they are worth.
