    Goodwill Taking Advantage Of The Disabled

    Goodwill is one of the nation’s best-known so-called charities and is paying disabled workers as little as .01 cent an hour, due to a 75-year-old legal loophole that experts say needs to be changed.

    Goodwill Industries, a multibillion-dollar company whose executives make six-figure salaries, is among the nonprofit groups permitted to pay thousands of disabled and handicapped workers much less than minimum wage due to a federal law known as Section 14 (c). Labor Department records show that some Goodwill workers in Pennsylvania earned wages as low as .22, .38, and .41 cents per hour in 2009.

    “If they really do pay the CEO of Goodwill three-quarters of a million dollars, they certainly can pay me more than they’re paying,” said Harold Leigland, who is legally blind and hangs clothes at a Goodwill for less than minimum wage.

    “It’s a question of civil rights,” added his wife, Sheila, blind from birth, who quit her job at the same Goodwill store when her already low wage was cut further. “I feel like a second-class citizen. And I hate it.”

    Section 14 (c) of the Fair Labor Standards Act, which was passed in 1938, allows employers to obtain special minimum wage certificates from the Department of Labor. The certificates give employers the right to pay disabled workers according to their abilities, with no bottom limit to the wage.

    Most, but not all, special wage certificates are held by nonprofit organizations like Goodwill who then set up their own so-called “sheltered workshops” for disabled employees, where employees typically perform manual tasks like hanging clothes or separating clothes hangers.

    Other businesses like restaurants and department stores sometimes benefit from section 14 (c). Taking advantage of the system by paying disabled citizens less than minimum wage has become a popular but scrutinized trend in the United States.

    When a non-profit provides Section 14 (c) workers to an outside business, it sets the salary and pays the wages. For example, the Helen Keller National Center, a New York school for the blind and deaf, has a special wage certificate and has placed students in a Westbury, New York, Applebee’s franchise. The employees’ pay ranged from $3.97 per hour to $5.96 per hour in 2010. The franchise said it has also hired workers at minimum wage from Helen Keller. Ocala Post reached out to Applebee’s, however they refused to comment.

    The Helen Keller National Center also placed several students at a Barnes & Noble bookstore in Manhasset, New York, in 2010, where they earned $3.80 and $4.85 an hour. A Barnes & Noble spokeswoman defended the Section 14 (c) program by saying “it provides jobs to people who would otherwise not have the opportunity to work.”

    Florida is by far the worst state for taking advantage of the disabled; which is ironic seeing as though Florida has some of the toughest laws on criminals that take advantage of the elderly or the disabled. In 2011 workplaces in Florida reported paying as little as one cent per hour to disabled workers. Ocala Post reached out to several businesses including Goodwill Industries for Central Florida and all refused to comment.

    Businesses and nonprofits are profiting from exploiting disabled workers. Defenders of Section 14 (c) say without it, disabled workers would have few options. The Department of Labor told Ocala Post that Section 14 (c) “provides workers with disabilities the opportunity to be given meaningful work and receive an income.” A fancy way of saying if the law did not exist, nonprofits and for-profit businesses would leave disabled citizens out in the cold.

    Harold Leigland, said he feels that Goodwill can pay him a low wage because the company knows he has few other places to go. “We are trapped,” he said. “Everybody who works at Goodwill is trapped.”

    Leigland, a 66-year-old former massage therapist with a college degree, currently earns $5.46 per hour working for Goodwill.

    Goodwill bases pay on “time studies” or “timed tests.” Staff members of Goodwill stand over the disabled employees with a stopwatch to calculate how long it takes for a person to hang hangers or articles of clothing. Are you sitting down? That time is then calculated against a person that does not have a disability. Goodwill then uses a formula to calculate the salary for that individual, which always comes out to be much less than minimum wage. Goodwill repeats the “tests” every six months.

    Goodwill also gets around the Family Medical Leave Act (FMLA). One worker with Goodwill was making $4.50 per hour, she had to have emergency knee surgery and when she returned to work, Goodwill knocked her down to $2.75 per hour without giving her a “time study.” That worker was eventually forced to quit her job.

    One worker said the “time studies” are stressful and sometimes it seems Goodwill staff make the tests harder just to be able to lower wages.

    Leigland’s pay has been higher than $5.46, but it has also dropped down to $4.37 per hour, based on the time-study results. He also said he believes Goodwill makes the time studies harder when they want his wage to be lower.

    In 2011 the CEO of Goodwill Industries of Southern California took home $1.1 million in salary and deferred compensation. His counterpart in Portland, Oregon, made more than $500,000. Salaries for CEOs of the roughly 150 Goodwill franchises across America total more than $30 million.

    Goodwill International CEO Jim Gibbons, who was awarded $729,000 in salary and deferred compensation in 2011, defended the executive pay.

    According to Goodwill’s own figures, salaries for the CEOs in 69 franchises that hold special minimum wage certificates totaled almost $20 million in 2011.

    Gibbons also defended the “time studies,” and the entire Section 14 (c) approach. He said that for many people who make less than minimum wage, the experience of work is more important than the pay. However workers that cannot pay their bills, disagree.

    The bill is opposed by trade associations for the employers of the disabled, and past attempts to change the law have failed. Marc Maurer, president of the National Federation of the Blind and a foe of the sheltered workshop system, says ” the current system sends the message that Americans who have disabilities aren’t as valuable as other people,’ and that’s wrong. These folks have value. We should recognize that value.”

    One worker said, “with CEO’s of Goodwill bringing home a total of $20 million in salaries, they do not seem so nonprofit.”

    Experts say as long as communities continue to support Goodwill, disabled Americans will continue to be taken advantage of.

    Man Touches Officers Penis At Paddock Mall

    Ocala, Florida — Today an Ocala Police Department detective was given information about an advertisement on Craigslist. The ad advised that a 56 year old male was looking for other men to perform oral sex on in the Paddock Mall food court restrooms.

    The ad advised that the man would be wearing tan pants, a dark blue shirt, and that interested persons should be between 20 and 50 years old, and weigh less than 200 pounds. The ad advised if interested “HMU,” which in cyber world means “hit me up.” The ad also advised that the subject would be present at the Paddock Mall location between the hours of 11 a.m. and 1 p.m.

    After reviewing the information, at approximately 11:10 a.m., Sergeant Eric Hooper arrived at the food court area of the Paddock Mall wearing plain clothes. Ten Minutes after arriving, Sergeant Hooper observed a subject fitting the description from the Craigslist advertisement.

    Sergeant Hooper went into the bathroom handicap stall and several minutes later, the male followed Sergeant Hooper into the stall and immediately put his hands on Sergeant Hooper’s penis over top of his clothing. Sergeant Hooper immediately advised the man to prove he wasn’t a police officer, and the man then exposed his penis. Sergeant Hooper then identified himself as a law enforcement officer and escorted the man out of the restroom.

    The subject arrested was identified as James Leroy Routson, 71. Routson advised that he had placed the ad on Craigslist and had lied about his age.

    Routson was transported to the Marion County Jail and charged with one count of Exposure of Sexual Organs. Routson posted his $500 bond and was released at 6:18 p.m.

    Skokie Village, Chicago — A Chicago woman has now filed suit against the village of Skokie and one of its police officers, Michael Hart, 43, after she was seriously injured after being shoved headfirst into a concrete jail cell bench. Cassandra Feuerstein, 47, was arrested for DUI back on March 10.

    Cassandra Feuerstein, 47, said in a federal lawsuit that the incident required facial reconstructive surgery and the insertion of a titanium plate to replace the bones that had been shattered.

    Like the recent incident in Marion County, it was recorded on jail video cameras.

    The video shows an officer searching Feuerstein inside the jail cell when she was asked to remove her boots and bra before being removed from the cell for additional processing.

    While attempting to take Feuerstein’s booking photo Hart appears to become agitated with her. Hart then grabs and twists Feuerstein’s arm and shoves her back into the cell.

    After Feuerstein’s face smashes into the concrete bench, blood can be seen that spilled onto the jail cell floor.

    According to reports, Feuerstein was charged with resisting a police officer. A Cook County court document filed by police said Feuerstein “knowingly resisted by pulling away from the officer and placed both her hands on the sides of the cell door in an attempt to not be placed into the holding cell.”

    The lawsuit also states that Hart made false statements to others in the Skokie Police Department about why he pushed Feuerstein into the jail cell, causing his fellow officers to write false reports on the incident.

    Feuerstein pleaded guilty to the DUI charge, but county officials dropped the resisting arrest charges. The lawsuit seeks an unspecified amount of damages.

    The officer had remained on his job with pay, but did not have contact with inmates, according to reports. After massive amounts of pressure from the media and citizens of Chicago, Hart was placed on suspension and was eventually arrested and charged with Aggravated Battery and Official Misconduct, but released the same day.

    Family of Feuerstein are outraged Hart’s arrest took so long and say if the cameras had not been in place, she would have been railroaded. Action was not taken against Hart until Feuerstein filed the lawsuit in October, seven months after the incident occurred. Feuerstein’s attorney stated that they are fortunate to have the video. The attorney also referred to officer Hart as a coward and a bully.

    A public records search of Feuerstein did not turn up with any previous arrests or traffic citations.

    Michael Hart did not seem to show any remorse in a media interview following his suspension and arrest.

    On December 10, 2013 the Village of Skokie appointed a new Village Manager, John Lockerby.

    Further details cannot be released due to the pending investigation and civil lawsuit.

    Christy Bostic-Petrain Charged With Child Neglect

    New Smyrna, Florida — On December 16, 2013 at approximately 1:38 p.m., a witness contacted the Volusia County Sheriff’s Office and advised she observed an intoxicated person operating a motor vehicle with a juvenile inside. The witness stated she pulled into the Walmart parking lot at 3155 SR 44, New Smyrna Beach and parked next to a red two door passenger car.

    According to the witness, she observed a female occupant of said vehicle, later identified as Christy Bostic-Petrain, 38, fumble with her seat belt, pulling and twisting it.

    According to reports, Bostic-Petrain then lit a cigarette backwards and tried to smoke it. The witness stated she could smell the distinct odor of the filter burning. After Bostic-Petrain smoked the cigarette, she began drinking a beer, according to the witness.

    The witness monitored Bostic-Petrain and watched her sit in the vehicle, as if she were waiting for a friend to exit the store. As witness watched, a young boy walked out of the store and got into the vehicle with Bostic-Petrain.

    The witness stated Bostic-Petrain then drove out of the parking lot at a high rate of speed and turn east onto SR 44. Before the vehicle fled the scene, the witness was able to obtain the vehicle’s tag number. The witness was unable to follow Bostic-Petrain, due to her erratic driving through the parking lot.

    Deputies and New Smyrna Beach Police Officers canvassed the area for the vehicle.

    New Smyrna Beach Police Officer Jones located the vehicle in the 2300 block of SR 44, New Smyrna Beach, as it traveled eastbound. Officer Jones advised he was behind the vehicle and observed it swerving in the inside lane, crossing over the lines.

    Officer Jones immediately conducted a traffic stop due to Bostic-Petrain’s erratic driving and to avoid her causing a car accident.

    According to reports, Bostic-Petrain did have a young boy in the car with her.

    Reports also indicate there were in fact alcoholic beverages in the car as the witness told dispatchers.

    Bostic-Petrain failed her field sobriety test and consequently was arrested. Bostic-Petrain was charged with Child Neglect and DUI.

    Officials say the witness kept the possibility of an accident from happening.

    The child was released into the custody of his father and the Department of Children and Families was notified.

    Marion County Sheriff’s Office Helps Feed The Needy

    Ocala, Florida — This morning more than 15,500 pounds of fresh oranges were picked in Marion County. The bulk of the oranges were off to the Marion County Jail, where the fruit is served as part of meals for inmates or the oranges are juiced. But the delivery truck made a special stop by Interfaith Emergency Services – a non-profit organization providing food, clothing, and shelter to people living in Marion County. Three thousand pounds of oranges were donated.

    The fruit will be shared by Interfaith, Salvation Army, and Brother’s Keeper Soup Kitchen. “The Sheriff’s Office is about more than putting people in jail and enforcing the law. We are also here to assist and support our community. Through these donations, we help out those less fortunate than ourselves,” said Sergeant David Hurst of the Marion County Sheriff’s Office.

    The oranges are from a bumper crop. The Marion County Sheriff’s Office has the Inmate Work Farm program that stretches over 431 acres in four locations throughout the county. The farm in Citra produced the citrus that was handpicked by Marion County Sheriff’s Office inmates.

    Interfaith Emergency Services’ food pantry manager Thomas Curtis welcomed the delivery and the nutritional value. “It’s a good wholesome food that provides nourishment, vitamins, – all the good stuff,” Curtis said. “It’s not junk food, we rather have 3,000 pounds of oranges than 3,000 bags of potato chips,” he said.

    Officer Teacher Attorney And Others On Naughty List

    Polk County Sheriff’s Office detectives conducted a four-day prostitution investigation that resulted in the arrests of 80 suspects on a variety of charges, including Soliciting for Prostitution, Soliciting Another to Commit a Lewd Act, Deriving Support/Proceeds from Prostitution, and Aiding/Abetting Prostitution.

    The investigation was conducted at an undercover location in Polk County from Thursday, December 12th to Sunday, December 15th, 2013. Detectives answered and placed ads on Internet websites such as Backpage.com. Undercover detectives arrested 24 men who were soliciting (“Johns”), 33 prostitutes, 13 who were Aiding and Abetting Prostitution or Deriving Proceeds from Prostitution, and 10 others for a variety of drug and other charges.

    Detectives say 66 percent of those arrested (53 out of 80) have previous criminal histories including charges such as attempted murder, aggravated stalking, kidnapping, robbery, child abuse, battery, theft, fraud, and drug crimes. In total, they had been charged with 395 crimes, an average of 7 ½ crimes each.

    Prostitution is not a victimless crime. From the spread of disease and destruction of families to human trafficking, prostitution is bad for our community. We arrested a 16-year-old girl from Orlando on Saturday for prostitution—she was driven to our undercover location (along with a 26-year-old female prostitute) by a 20-year-old man. The teen is clearly a victim of sex trafficking. We arrested the driver for Deriving Proceeds from Prostitution and we are going to do everything we can to get her help and find out who is involved in trafficking this teenager,” said Sheriff Grady Judd.

    Detectives learned that 22 of those arrested are receiving Food Stamps benefits and those benefits are possibly being used in a fraudulent manner. Nine of the “johns” told deputies that they were married and one was engaged to be married. Five of the prostitutes told deputies they were married.

    Among those arrested in the investigation are:

    A 16-year-old girl from Orlando. She was charged with prostitution along with 26-year-old Amanda Parker of Orlando. They were brought to the undercover location by 20-year-old Stanley Benson, also from Orlando. He was charged with deriving proceeds from prostitution. Detectives are now conducting a human trafficking investigation.

    32-year-old Justin Bachand of Lakeland is employed as a Florida Department of Corrections Probation Officer. He solicited an undercover female detective to expose her breasts and have protected sexual intercourse in exchange for money.

    50-year-old Mark Graffrath of Lakeland was arrested during two previous PCSO prostitution operations. This time Graffrath solicited an undercover female detective for sexual intercourse without a condom in exchange for money. This is the same undercover female detective that resulted in Graffrath’s arrest in 2008.

    47-year-old Richard Sierra of Altamonte Springs is an attorney for Kosto & Rotella Law Firm in the Orlando area. He traveled to the undercover location to have a “Girlfriend Experience” (sexual intercourse) in exchange for money. Sierra attempted to conduct a pat-down, stating when he did this he usually pats the girl down for wires. He was charged with Soliciting Prostitution and Assault. Sierra told deputies he was married.

    43-year-old Christopher Havlicek of Palm Beach Gardens is the Managing Director/Palm Beach Market Manager for JP Morgan Chase Bank. He negotiated to be with an undercover female detective for ½ hour for cash. Havlicek then immediately disrobed and got onto the bed. Havlicek told deputies he was married. According to NBA.com, Havlicek is a former reporter for NBA TV.

    50-year-old Anthony Stevens of Groveland is a Special Education Teacher at Groveland Elementary in Lake County. He solicited a female undercover deputy for sex / GFE (girlfriend experience) in exchange for money. Stevens told deputies he was married.

    30-year-old Terra Webb and 43-year-old Charles Kinsey were a couple from St. Petersburg, Florida. They arrived at the undercover location with a 3-1/2-month-old baby. After Kinsey didn’t hear from Webb he came to the undercover location with the baby. DCF was notified and the baby was turned over to their custody. Webb had negotiated money for sex with a male undercover deputy—she was arrested for Soliciting Prostitution and he was arrested for Child Neglect/Endangerment.

    54-year-old William Higbee of St. Petersburg arrived at the undercover location with a bag of domination sex toys, including but not limited to a whip, leather/chain shackles, leather collar, ball gag, and a bottle of Vodka. Higbee is also part owner/chef at Cafe 6200 in St. Pete. He was arrested for Soliciting for Prostitution.

    35-year-old Toni Sella of Tampa claims to be a porn star and provided the link to her pornographic website to the undercover detective. She stated she is on disability and receives $1,600 a month but she charges for different services on her website. She says her stage name is Ella Meadows. She was charged with Soliciting Prostitution.

    Ocala Post obtained video from the sting. The audio has been removed due to the fact that it will be used during the investigation and court hearings.

    NSA Spying Tactics Deemed Illegal

    A federal judge ruled Today that the National Security Agency’s (NSA) collection of phone records violates the Constitution’s ban on unreasonable searches.

    U.S. District Court Judge Richard Leon granted an injunction sought by plaintiffs Larry Klayman and Charles Strange, concluding they were likely to win the battle in their constitutional challenge. Leon ruled Today that the two men are likely to be able to show that their privacy interests outweigh the government’s interest in collecting the data. Leon says that means that the massive collection program is an unreasonable search under the Constitution’s Fourth Amendment.

    The collection program was disclosed by former NSA systems analyst Edward Snowden, which started a frenzy over civil liberties being violated.

    The Obama administration has repeatedly defended the program, claiming the program is need to catch terrorists.

    Leon says that the government has not proven a single instance in which the illegal spying program has actually stopped an imminent terrorist attack.

    Leon said, “I have serious doubts about the efficacy of the metadata collection program as a means of conducting time-sensitive investigations in cases involving imminent threats of terrorism.”

    Leon said he is staying his ruling pending an anticipated appeal by the government and in light of the significant national security interests at stake in this case and the novelty of the constitutional issues.

    Ralph Garlick Tried To Leave Newborn Baby Out In Cold

    Volusia County — A man who reported finding an abandoned newborn baby wrapped in newspaper outside of a convenience store, was actually the man that left the baby there in the first place.

    According to reports, Ralph Garlick Jr.,53, had told deputies he heard the sound of a baby crying and discovered the infant girl around 2:30 a.m. Monday, outside the DeBary Food Mart on South Charles R. Beall Boulevard. Garlick later admitted he lied about finding the baby, and told investigators his girlfriend had given birth to the child earlier that morning at the Oak Shade Apartments, in Orange City.

    Garlick, who says he is not the father of the baby, claims he was trying to bring the baby to a safe location because his girlfriend didn’t want the baby she had just given birth to, according to deputies.

    Reports show Garlick also lied about his own name, he originally identified himself as Charles Garlick, the name of his deceased brother.

    The baby was taken by ambulance to Arnold Palmer for Children in Orlando, after a newspaper delivery man whom Garlick had flagged down for help called 911.

    The delivery man, Anthony Ackeridge, had Garlick bring the baby into his van while he called for help.

    A spokesperson for the Florida Department of Children and Families said the baby was in good health at Winnie Palmer Hospital, where she will remain for the next several days.

    DCF released this statement Monday afternoon:

    We believe this setting offers the best quality of care for her at this time. Her admission allows child protection officials the opportunity to further explore all of the circumstances which led to her discovery, confirmation of the identity of the birth parents and intention of the actions of those involved, before making any final and legal decisions on the newborn’s behalf.”

    The child’s mother was later located and taken to Central Florida Regional Hospital in Sanford. Investigators said they were currently interviewing her to get her side of the story. Further details on the mother have not yet been released.

    In the state of Florida, Safe Haven laws allow birth parents to safely drop off unwanted children up to 7 days old at a fire station or hospital without facing charges. DCF said infants surrendered through the Safe Haven Law are directly placed with approved adopted parents through private adoption agencies, and do not enter the foster care system.

    Temperatures were in the 30’s at the time Garlick tried to leave the newborn behind, just hours after she was born.

    Garlick was arrested and charged with Knowingly Giving False Information to Law Enforcement during an investigation, and Resisting an Officer Without Violence.

    Garlick was booked into the Volusia County Jail and is being held on a $5,000 bond.

    Marion Oaks, Florida — Mary Alexander, 47, of Ocala is still claiming charges against her are “made up.” As Wesley Snipes did during his trial for failing to pay taxes, Alexander is also claiming Marion County is a racist county. Alexander is claiming the Marion County Sheriff’s Office is targeting her because she is black.

    In June, Alexander wrote a letter to Jesse Jackson and Reverend Al Sharpton claiming she is being targeted because she is a black “business woman” after she was arrested and charged with felony fraud and operating an illegal elderly home in Marion Oaks.

    Alexander was arrested again on December 10, 2013, and charged with organized fraud.

    Alexander’s attorney, Todd Hopson, claims Alexander didn’t break any laws. Hopson said they will be able to prove she used the stolen EBT cards legally.

    Victims have previously stated they didn’t apply for Food Stamps, instead, Alexander applied using their information then used the EBT cards.

    During the execution of a search warrant, investigators found ten (10) Electronic Benefits Transfer (EBT Food Stamp) cards in Alexander’s purse and none of the cards belonged to her.

    Investigators working with the United States Department of Agriculture learned that Alexander used at least two cards on 35 different transactions to purchase more than $3,000 in various items. Investigators said Alexander did not have permission to use any of the cards.

    The National Action Network Central Florida chapter, founded by Reverend Al Sharpton, said they are standing behind Alexander.

    Ocala Post was contacted by the NAACP following the first article on Alexander and they demanded Ocala Post take it down. Ocala Post respectfully denied that request.

    Residents of Marion Oaks, who do not wish to be identified in fear of retaliation, said they are disgusted that Alexander is using race to try and avoid felony charges. One resident said, She abused the system and she abused the elderly, both physically and mentally, she should pay for her crimes.”

    The investigation is ongoing.

    Three Sisters & One Friend Rob For Christmas

    Rock Hill, North Carolina — Four women could be facing 10 years in prison, spending their holidays behind bars after being arrested and charged in a shoplifting ring.

    Police said, ” four brazen low lives stole from Belk, JCPenney, Kohl’s, Hobby Lobby, T.J. Maxx, Ross, and Walmart in Rock Hill, along with several other stores at Concord Mills mall.”

    Police say they have been investigating for about a month, after seeing surveillance video from the Walmart on Dave Lyle Boulevard in Rock Hill. The Video shows four women pushing a dozen shopping carts right out the door of the garden center, overflowing with thousands of dollars in merchandise, while a clerk watches and does nothing.

    Rock Hill Police Officer Mark Bollinger said they weren’t finished, either. “They went out to their car in the parking lot, offloaded everything, and went back into the store, loaded them up again, and walked out,” Bollinger said.

    According to reports, police served search warrants on four houses and found stacks of wrapped Christmas presents that were wrapped with stolen wrapping paper. Police had to unwrap every stolen gift.

    Police found toys, clothing, and more than $5,000 worth of other items in the homes of the four suspects. The total value is unclear at this time but is estimated to be over $15,000 including the wrapping paper.

    Police arrested twin sisters Stephanie Barber and Stacey Barber, both 35, older sister Kimberly Barber, 36, and a friend, Twanna McCleave, 30. Records show that Stephanie and Stacey Barber have multiple previous convictions involving retail theft.

    Police are attempting to return all of the merchandise to the proper stores.

    A spokesman for one of the stores said, “incidents like this is what forces retailers to raise prices, people steal and honest people pay the price.”

    The investigation is still open.

    Ocala Post reminds Residents to be careful when having packages delivered and when throwing out empty boxes from big-ticket items purchased during the Christmas season. This time of year thieves aren’t just scoping your house for delivered packages sitting on your porch, but also your trash. It is not uncommon for a thief to drive by a house looking for delivered packages or empty boxes with labels by the trash cans. If a package is sitting on a porch or by the front door, it is a dead giveaway the home owner is not home. And if there are labeled empty boxes by the trash cans, when the home owner leaves, thieves may burglarize your home.

    If possible, have packages delivered to your place of employment, if not, then be sure someone is home to accept the package.

    Empty boxes are billboards to thieves, it is advertising as to what is inside your home. The best way to get rid of holiday boxes is to drop them off at a local recycling center. If getting to a recycling location is not an option, conceal your boxes as best you can. Break them down, rip them up before putting them in the trash, or put the boxes in black trash bags.

    Burning the boxes is not recommended.

    Do not dump boxes in bins that are not authorized for public dumping, illegal dumping will not be tolerated by law enforcement.

    Check with the local recycling facilities for hours of operation and what type of materials are accepted.

    Corrections Officer Rayschella Forbes arrested for smuggling

    Marion County, Florida –Florida Department of Corrections Officer Rayschella A. Forbes, 25, was arrested in Marion County on December 11, 2013.

    Forbes was hired by the DOC in September of 2009 and she worked at the Marion Correctional Institution, according to a DOC spokesperson. MCI began her termination process once they learned of her arrest.

    Forbes was arrested for smuggling clear alcohol in water bottles, K2, as well as other contraband items into the prison. She is also accused of organizing a financial plot in which she profited within the prison.

    According to officials, the investigation began back in May of 2013 after the Inspector General for the Florida Department of Corrections was tipped off that Forbes was involved in the smuggling at the Gainesville Work Camp located at 1000 NE 55th Boulevard. During the investigation officials say they also learned that family members of an inmate was sending money orders to Forbes’ sister , Mershaa Farmer. Forbes would then reward the inmate with food and canteen items.

    According to investigators, Farmer denies knowing any inmates at the facility. However, she admitted that Forbes came to her and asked to use her identity in order to allow family members to send money orders in exchange for acting as a body guard for inmates and keeping them out of trouble. Farmer also told investigators that the money was a “gift” from family members, and the money would be divided evenly between she and Forbes.

    According to reports, Forbes is claiming she was set up by other corrections officers in a carefully thought out conspiracy in order to get rid of her. Forbes also said she did not conspire with family members to collect money to protect inmates and accused Farmer of lying.

    Forbes was arrested by the Marion County Sheriff’s Office and is being held on a $100,000 bond.

    Forbes’s salary at the time of her arrest was $32,229.68.

    Gainesville Man Arrested For Food Stamp Fraud

    Gainesville, Florida — Alachua County Detectives with the assistance of the Florida Department of Financial Services State Law Enforcement Bureau (SLEB) served a search warrant on December 11, 2013 at 4816 SW 80th Place, Gainesville, Florida.

    The search warrant was the final result of an ongoing covert investigation into the illegal sale for cash of EBT (Food Stamp)cards.

    According to reports, the investigation revealed that Gregory “Greg” Liuzzo, 55, was purchasing the cards for cash payments that were substantially less than the value left on the cards. Liuzzo would then use the cards to purchase grocery items for himself or members of his family. Often times Liuzzo would then return the cards to the person they were issued to in order for the card to be reloaded. Liuzzo would then repurchase the card at a later date.

    Detectives said they do not have a grand total of the fraud amount at this time, however they say it is substantial.

    According to investigators, more arrests are expected due to the fact that the sellers of the cards committed fraud as well..

    Detectives arrested Greg Liuzzo, of Gainesville, and charged him with 26 counts of Fraud Aid and Abet Public Fraud, Fraud Obtain Property by False Personation, Fraud by Misrepresent Personal Identification Information, and Racketeering.

    He has been booked into the Alachua County Jail and his bond was set at $200,000.

    Video: Corrections Officer brutally slams inmates head into concrete wall

    Ocala, Florida — Corrections Officer, Charles Craig Broaderick, 41, was charged with battery after he slammed an inmate’s head into a concrete wall while he (the inmate) was handcuffed.

    The inmate, who was identified as James Duckworth, 33, was arrested and transported to the Marion County Jail by the Ocala Police Department for suspicion of DUI.

    Broaderick said he slammed Duckworth’s head into the concrete wall because Duckworth spat at officers. However, after carefully reviewing the video, it appeared Duckworth had something in or on his mouth he was trying to clear but did not actually spit at officers.

    After Officer Broaderick slammed Duckworth’s head against the wall he pressed on the inmate’s neck with his fist, at which time the inmate appeared to lose consciousness for a brief moment.

    Immediately following the incident, blood could be seen smeared across the wall.

    Broaderick told Duckworth several times to hold up his head, despite being unconscious.

    At one point in the video, Broaderick is heard saying, “I guess I have to write a report now.”

    Broaderick claimed Duckworth was “acting up,” but in the video, Duckworth could be heard telling one of the officers that he was a gentleman.

    It wasn’t until after Duckworth’s head was bashed against the wall he is heard using derogatory language toward the officers.

    Duckworth can also be heard multiple times telling the officers that his head hurts.

    The incident happened in October, and on November 25, 2013, the State Attorney’s office announced they were pressing charges.

    Broaderick turned himself into the jail on Tuesday, booked into the jail at 4:30 p.m., and released approximately 12 minutes later on a $2,000 bond.

    According to reports, the State Attorney’s Office met with Sheriff Chris Blair’s senior staff in regard to the incident.

    Reports indicate that as soon as Blair was briefed, he took immediate action.

    Blair said, “Employees of the Marion County Sheriff’s Office are expected, and required, to maintain the highest level of integrity and accountability in our dealings with the public, including inmates incarcerated in the Marion County Jail.” Adding, “the sheriff’s office takes any allegations of misconduct, whether in the jail or otherwise, extremely serious and MCSO will not condone any inappropriate or criminal conduct. When and where such allegations of misconduct arise, I will act promptly to determine the merit of the allegations and levy appropriate discipline while also respecting the individual’s right to due process through the criminal proceeding.”

    Broaderick was placed on unpaid suspension following his arrest pending the conclusion of a criminal investigation.

    Marion Oaks: Mary Alexander arrested for food stamp fraud

    Ocala, Florida — Mary Alexander, 47, of Ocala has been charged with organized fraud.

    Alexander’s arrest, today, stems from an ongoing investigation by the Marion County Sheriff’s Office, in conjunction with the Medicaid Fraud Unit of the Attorney General’s Office.

    The first phase of this case started back in June of this year. That’s when both agencies executed multiple search warrants on Alexander’s homes. The concern was that Alexander was operating unlicensed assisted living facilities and neglecting the elderly and/or disabled adults living in her homes. Alexander and Tara Collins-Johnson were arrested in June on these grounds and both charged with multiple felonies.

    The illegal assisted living homes were being operated in Marion Oaks.

    During the execution of the search warrants, investigators found ten (10) Electronic Benefits Transfer (EBT Food Stamp) cards in Alexander’s purse and none of the cards belonged to her.

    Investigators working with the United States Department of Agriculture, learned that Alexander used at least two cards on 35 different transactions to purchase more than $3,000 in various items, and Investigators say Alexander did not have permission to use the cards.

    According to reports, Alexander “engaged in a scheme to defraud” by obtaining the EBT cards in the names of at least two victims without their knowledge.

    One of the victims interviewed told investigators that he had never applied for Food Stamps.

    Surveillance video that was obtained from Winn-Dixie shows Alexander using one of the EBT cars that she illegally obtained.

    Alexander and Tara Collins-Johnson have also been accused of elderly abuse and stealing social security checks from elderly victims.

    Alexander and Collins-Johnson wrote a letter to Jesse Jackson and Reverend Al Sharpton back in June asking for their help. Alexander and Collins-Johnson wrote, “We are being targeted because they are black business women.”

    Despite the massive amount of evidence that has been gathered by authorities, both claimed they did nothing wrong.

    Alexander has been arrested and booked into the Marion County Jail on felony fraud charges. Alexander’s bond amount is $5,000.

    DeLand, Florida — 911 Operator: When was the last time you saw it?

    Driver: Three o’clock yesterday [Saturday] was the last time I saw the truck. It’s hooked to a trailer as well, fully loaded, with chocolate.

    911 Operator: Fully loaded with chocolate, huh?

    Driver: Yeah, someone with a sweet tooth.

    911 Operator: Well, you know, maybe that’s what they were going for. Who knows?

    The call is from a truck driver reporting his stolen semi-truck. According to deputies, the semi-truck was stolen from the JD Lewis Truck Center, on International Speedway Boulevard near the DeLand airport sometime over the weekend.

    The driver said the truck was loaded down with $120,000 in Hershey’s Chocolate. The driver also said that if the thief doesn’t keep the chocolate cool, there will be a huge chocolaty mess to clean up.

    According to deputies, the truck owned by Sun State Carriers in Tavares, is a 2012 Freightliner Cascadia with red and orange stripes, valued at $90,000. A spokesman with Sun State Carriers said he would not comment on the theft and refused to provide a picture of the truck.

    The JD Lewis Truck Center allows truckers to use space for free and provides drivers with a remote control to open the gate.

    According to the Volusia County Sheriff’s office, there might be surveillance video available; however ,they are not releasing it at this time.

    Samuel Kaham Throws Block At Moving Car

    Dunnellon, Florida — On December 8, 2013 Deputies were dispatched after receiving a call about a man battering his girlfriend.

    Deputy Lightle met with the victim and a witness at the Walmart Parking lot in Dunnellon, Florida. The victim advised that she had been in an ongoing argument with Samuel Kaham, 31, over the course of the evening. The victim advised that she had a mutual physical altercation with Kaham after she (victim) attempted to retrieve her belongings from her home .

    The victim stated she was trying to leave the residence located at 19790 S.W. 107th Lane. The victim advised Deputy Lightle that she called the eyewitness to come pick her up so that she could gather her things and leave the property.

    After the eyewitness came to pick her up, the victim advised that she packed up her belongings into the witnesses car. According to reports, as the two began to drive away from the residence, Kaham took a cinder-block, broke it up on the street, and then threw a large piece of block at her car, striking and shattering the wind-shield and denting the door panel.

    Deputy Lightle noted that the damage was clearly visible on the car.

    The victim advised that she drove away from the residence at that point and called the sheriff’s office.

    According to reports, the eyewitness separately confirmed the victims account of the incident. Both victims told the deputy that they were scared and in fear for their lives.

    Deputy Lightle then went to Kaham’s residence, located down the street from the incident location. Post-miranda, Kaham admitted to throwing a piece of brick at the victim’s car.

    Kaham was arrested and transported to the Marion County Jail without further incident, he was charged with Throwing a Missile Into an Occupied Vehicle.

    Samuel Kaham is a felon previously convicted of Possession of Cocaine with Intent to Distibute.

    Kaham’s Bond was set at $11,000.

    Paramedic & Deputy That Are Twin Brothers Arrested

    Winter Haven, Florida — Polk Fire Rescue Paramedic Warren “Nick” Nichols, 49, was arrested after authorities were made aware of a sexual relationship he had been having with a 17-year-old female.

    The mother of the 17-year-old girl found text messages between Warren and her daughter. The mother confronted her daughter who denied she was in a sexual relationship with Warren.

    Warren was dating and living in the home with the mother for seven months at the time of the incident.

    On December 2, 2013 the daughter, now 18, gave a recorded statement in which she said she was involved in a sexual relationship with Warren for approximately one month before she turned 18. The girl stated that her mom took her cell phone on November 11, 2013 and saw text messages between her and Warren. The girl said her mom then asked if she was in a relationship with Warren and she said, “no.”According to the girl, her mom became enraged then picked up a Glock semi-automatic handgun off of the bedroom nightstand, pointed it at her, and asked again if she was having a relationship with Warren. The girl stated it was at that time she admitted to being involved in a relationship with Warren a few months prior to her mom finding the texts. The girl told investigators that during the relationship with Warren she texted him one nude picture of herself.

    After the text messages were found, the mom continued to allow Warren to stay in the house. The mom told authorities she became “the warden” and made sure Warren and her daughter did not communicate via text, and they were not left alone together except for four hours on Thanksgiving night.

    Authorities later discovered that Warren’s twin brother William Nichols,49, a supervisor with the Polk County Sheriff’s office knew about the relationship. William had texted his brother and told him he didn’t condone a 49-year-old man having a relationship with a then 17-year-old girl. William told authorities that he was told and was under the impression that information about his brother had already been relayed to investigators, but he didn’t confirm the information had been passed on. William told authorities he in no way approved of the relationship. William also told authorities that his brother Warren stated that the mom had “manic” periods where she (the mom) could not decide if the allegations had actually occurred. William told authorities that the mom wanted to get marry his brother Warren, and the mom got angry when Warren said no. William said it was at that time the mom started suggesting that Warren was having an inappropriate relationship with her daughter. According to reports, William told investigators that Warren told him that the mom was very abusive toward her daughter in the seven months he dated her (the mom) and he felt sorry for her (the daughter). William said the mom would repeatedly send his brother text messages accusing him of having sex with her daughter, and in the the same text message say I love you.

    F.S.S. 39.201 (c) states: Any person who knows, or has reasonable cause to suspect that a child is the victim of childhood sexual abuse or the victim of a known suspected juvenile sexual offender, shall report such knowledge or suspicion to the proper department.

    F.S.S. 39.205 Penalties relating to report of child abuse, abandonment, or neglect states, “A person who is required to report known or suspected child abuse, abandonment, or neglect and who knowingly and willfully fails to do so or who knowingly and willfully prevents another person from doing so, commits a felony of the third degree.”

    Bill Nichols was hired by the Polk County Sheriff’s Office in February 1988 as a deputy sheriff; he was promoted to Sergeant in 1998; he was promoted to Lieutenant in 2006. His most recent assignment was in the Central District (Winter Haven area). His most recent salary was $73,787. He resigned effective immediately upon his arrest.

    Warren Nichols has been booked into the Polk County Jail and charged with 30 counts Unlawful Sex With Certain Minors, where he will remain on no bond until a first appearance.

    Warren was also charged with one count Domestic Violence with a Battery for an altercation that occurred between him and the mother in regards to the alleged sexual relationship with her daughter.

    According to reports, the mom knew about the alleged sexual relationship in early November but did’t report it to authorities until December 2, 2013.

    The mother was charged with one count Child Abuse for pointing a handgun at the girl during an altercation about the ongoing sexual relationship between the girl and Nichols. Her name and photo have not been released.

    Bill Nichols was booked into the Polk County Jail and charged with one count Failure To Report Suspected Child Abuse (F-3). He was released after posting $2,500 bond.

    Samuel Bing Wanted For Beating Elderly Man

    Ocala, Florida — The Marion County Sheriff’s Office needs your help in finding Samuel Bing, 25, of Reddick. Bing is accused of beating a 66-year-old elderly man in the face, breaking multiple facial bones.

    The victim is also mentally disabled due to dementia and schizophrenia, and needs 24-hour care.

    According to authorities, Bing was hired to take care of the victim while the legal guardian of the victim was out of town.

    The guardian arrived home but didn’t notice the victims face until the next morning, according to reports. The guardian said that the entire right side of the victims face was swollen and the victim could not open his right eye. According to the guardian, when she asked Bing if he had hit the victim, he replied in cocky manner, “yeah I hit’em.” Bing then left the house.

    The victim was admitted into the hospital unable to speak and deputies cannot question the victim due to his dementia.

    A Marion County Sheriff’s Office Deputy was able to contact Bing via phone, initially Bing agreed to meet detectives, however Bing didn’t show up to the meeting. Bing now refuses to turn himself in to law enforcement.

    Bing is a black male with brown hair, brown eyes and he stands about 5-foot, 11 inches
    and weighs around 160 pounds. Bing is a convicted felon also goes by the nickname “Bubba.”

    Oriana Farrell jailed – New Mexico State Police Officer fired for firing at a van full of kids

    New Mexico — The New Mexico State Police Officer, who fired shots at a minivan full of children during a hectic traffic stop, has been fired.

    On October 28, 2013, New Mexico State Police Officer Tony DeTavis stopped Oriana Farrell, 39, for speeding. Farrell’s license was also expired. According to reports, Farrell argued with Officer DeTavis over the ticket he had issued to her for speeding, and as Officer DeTavis was returning to his vehicle, Farrell decided to take off with a minivan loaded with children.

    According to Officer DeTavis, he pulled Oriana over again and then ordered her out of the minivan but she refused to comply.

    At one point, Officer DeTavis stated, Oriana’s son exited the van and rushed him. Police backup arrived shortly after.

    According to reports, during the scuffle Oriana and her children got back into the van and proceeded to flee for a second time. As Oriana drove off, Officer Elias Montoya fired shots at the minivan full of children, some as young as six years old, according to reports. Oriana led police on a chase at speeds of 100 MPH with her children in the minivan.

    Officer Montoya was placed on administrative leave with pay earlier this week following an investigation into the shooting, which took place outside the northern New Mexico tourist town of Taos. However, Lieutenant Emmanuel Gutierrez, a State Police spokesman, said he confirmed with State Police Chief Pete Kassetas that Officer Elias Montoya is no longer employed by the department. Montoya’s termination was effective at 5 p.m. on December 6, 2013. Montoya has 30 days to file an appeal for his firing.

    Montoya wrote in a police report, “I aimed at the left rear tire in an attempt to immobilize the vehicle.”

    On Tuesday, he was notified that the agency proposed to fire him, and Kassetas, in consultation with Department of Public Safety Secretary Gorden Eden, made the final decision after a disciplinary hearing Thursday.

    Gutierrez issued a brief statement on the firing, but agency rules prohibit additional public comment because it’s a personnel matter that can be appealed.

    Montoya had worked for the New Mexico State Police for 12 years with no prior complaints.

    Oriana and her son were arrested in front of a hotel after the chase came to an end. She faces charges of Child Abuse, Fleeing and Eluding, Resisting Arrest, and Possession of Drug Paraphernalia for a pair of marijuana pipes that authorities say were in the van. She has since been released on bond.

    Ocala Post was unable to obtain information on Oriana’s son; however, Ocala Post did obtained the full dash cam video from State Police.
