OPD: Man justified in shooting of Vanguard High School student

    Jeffery Scott

Ocala Police Department Detectives have concluded that the shooting of Vanguard High School student Jeffery Scott and former Student Marcus Cooper, was justified.

The man who shot him, 54-year-old Edrige Rivers, will not be charged.

According to surveillance video, as well as multiple student witnesses, Scott was the first to pull a gun during the altercation.

Prior to the shooting, Scott was in a fight after a basketball game at Vanguard. Witnesses say the fighting that was initiated by Scott. Students also said it’s not the first time Scott has been involved in this type of off-campus activity.

Following the fight, two teens who were involved in that fight were sitting in their car at their friend house who had been badly beaten.

While the teens were parked in the 2200 block of Northwest First Avenue, a vehicle driven by Cooper, with Scott as the passenger, pulled up at the location.

Surveillance video shows that Scott immediately exited the vehicle, approached the car, and pulled a gun on one of the juveniles. Scott then began threatening to shoot the juvenile. Marcus then walked to the driver’s side and confronted the other juvenile.

Rivers was driving by as the confrontation was taking place.

Rivers saw that the two juveniles were being held and gunpoint, at which time Rivers ordered Scott to put his weapon down and leave.

Police said that Scott refused to comply.

Rivers then pulled his weapon and fired shots at Scott and Cooper.

Scott then returned fire, firing several shots at Rivers as he was moving his car away from the scene.

Scott was transported to a local hospital where he later died. As of Wednesday, Cooper remained in the hospital in serious condition.

Everyone involved in the incident was interviewed.

Due to the fact that surveillance video captured the entire incident and supported witness statements, Rivers was justified in his actions in protecting the life of another who was in imminent danger.

At this time, OPD cannot release the video. Once the State Attorney’s Office has reviewed and closed the investigation, the video will be released.

Sources say that Rivers had a concealed carry permit; however, OPD said they could not confirm this information at this time.

Police are still searching for the person who set fire to the house where the shooting occurred.

From the editor: Complaints, threats, & assumptions

barking up the wrong tree, ocala post, ocala news

[Last updated on December 15, at 6 a.m.]

Ocala Post recently received several threatening e-mail and Facebook messages from individuals complaining about the photo of an 18-year-old Vanguard High School student killed in a shooting.

Some of the threats (which were all in writing) have included lawsuits, “beatn’ dat azz [sic],” and other threats of bodily harm. Many of the threats are from felons who have lost their rights to vote and/or to own a gun, while others were from VHS students who have the worst vocabulary and grammar many have ever seen.

Most disturbing, though, is how quickly today’s generation, or a felon who runs a Facebook group, will accuse an individual or the media of being racist. Fact is, not one sentence in the article mentioned race, nor did it imply anything about race. The article did not so much as call the victim a “thug” as many have falsely stated.

Ocala Post never implied the victim was a “gangbanger.” Again, this was an assumption by many of the commenters.

With vulgar language and threats, many have ordered Ocala Post to remove the photo. The editor chose not to do so on principle. The problem with today’s generation is that they feel entitled to everything. They feel they call the shots. And while most businesses and media outlets cave and refuse to publish the truth out of fear of retaliation, or fear that a law enforcement agency such as the Marion County Sheriff’s Office will no longer do business with them, Ocala Post is not that company.

The action taken by Ocala Post was in no way directed to the family or the deceased in a negative manner. All negativity came from, and only from, the commenters; except for a few readers who saw past the photo and concentrated on the teen who was shot.

    Truth

The truth is, it was the first commenter who asked, “Why you got to call him a thug and be all racist with that picure? [sic]” It was the commenters, many of them minors, who made their own assumptions about the photo. The public called it racist and stated the photo made the teen appear as if he were a “thug.” The public quickly judged the photo and made that assumption. Much like when some of you see a person sporting a Confederate flag and automatically assume the individual is a racist.

Ocala Post was accused of selecting “the one photo” that portrayed the 18-year-old in a bad light.

Fact: The photo used by Ocala Post was submitted by one of Jeffery Scott’s peers. His peer wrote, “This is how many of us knew Jeff.” As this editorial was being prepared, that same individual wrote and stated that he felt bad. So, he wrote Ocala Post and apologized. The person then respectfully, without threats or vulgar language, asked Ocala Post to use a different photo (which Ocala Post will do out of respect for the student, a specific teacher he mentioned, and the family). Since Scott’s peer still attends VHS, he has asked to remain anonymous.

Furthermore, Scott’s Facebook account was filled with the same types of photos Ocala Post initially printed. Photos portraying gang signs, “flipping the bird,” as well as gun gestures, but not a senior photo. Ocala Post obtained the senior photo after the fact. Ocala Post never once stated the original photo was a reflection of Scott. Those are the facts.

Even more grossly absurd is commenters stating that Ocala Post intentionally uses mug shots of black males to make them “look bad.” Ocala Post uses mug shots of all races. Stating that Ocala Post makes criminals look bad is almost as ignorant as a reader who accused Ocala Post of fueling her drug addiction over an article written about her felonious ways.

Ocala Post uses court records and photos provided by local and state governments. All material is public record. If you do not want your face to end up in an article, stop breaking the law.

Again, these comments are explicit and many are from individuals unable to vote.

Also, in order for an article to be considered slander or defamation of character, the contents of the article would need to be false. Ocala Post has had to retract zero articles since its inception. Why? Because our investigative journalists go above and beyond.

Typically, it’s the criminal, one of their close friends, or family members who allege an article contains false information.

Ocala Post will stop printing names in articles and stop using photos when criminals stop breaking the law. As long as Freedom of the Press is protected by the United States Constitution, and Florida allows the press access to public records, Ocala Post will continue to print the names and photos of criminals in all articles. Ocala Post staff are instructed not to leave out any details from official reports, unlike other media outlets. And Ocala Post always strives for accuracy.

Marion County residents have an absolute right to know who is living next door.

As far as minors are concerned, if you do not wish to have your child’s name or photo published on Ocala Post, perhaps you as the parent should be more aware of your child’s behavioral problems and know their whereabouts at 2 a.m.

Also, claiming that your child has good grades and good classroom behavior does not mean your child is not felon material outside of the classroom. Statistics show that serious disrespect outside of the classroom toward others, abuse toward animals, or sex crimes against another, are red flags and usually stem from dysfunctional families already familiar with the criminal justice system. If you as the parent refuse to discipline, do not monitor your child’s social media, or have an extensive arrest record yourself, what do you think is going to happen?

If your child or family member causes harm to another human being, terrorizes or sexually abuses other children, or mutilates animals for the thrill of it, residents have the right to know in order to protect their families and other law-abiding citizens from becoming victims.

Ocala Post will not back down due to threats. Ocala Post will not back down to those who are also the same people who would block traffic on a highway for a meaningless protest. It’s time to stop being offended by everything and throwing temper tantrums when you do not get your way.

Also, Ocala Post does not delete comments or block users with respect to free speech; however, threats of bodily harm are not protected under free speech like some Facebook attorneys would like to think. (If your comment was removed and there was no threat involved, then one of your peers reported it.) Threats of bodily harm toward another on Facebook are an arrestable offense and are a quick way to join the very criminals you are “sticking up for” via comments. (This is a general statement and not in any way directed at Jeffery Scott.)

And just because you might have been arrested and bonded out of jail 20 different times due to our weak justice system, does not mean you know the law.

Additionally, we do invite you to join the conversation and have a respectable debate. And if you do, try to at least pretend like you are educated and are not reading from a book purchased at Thugs “R” Us. A person might also want to know the difference between right and wrong before defending a criminal.

If you feel this response is unprofessional or are offended, you are most likely one of “those” people.

As for the individuals who actually care about their children or family members being productive members of society and don’t leave all the discipline to teachers or law enforcement, we salute you.

When it comes to the safety of your children and family, the term “politically correct” should not come into question.

    Welcome to Ocala Post.

Note: Due to reports of harassment to some of Ocala Post’s loyal readers, the commenting policy has changed.

    Two deputies resign during investigation

ocala news, mcso, marion county sheriff's office

Marion County Sheriff’s Deputy Christopher Schanding and Detention Deputy Dustin Lay resigned during an investigation into their conduct at the Marion County Sheriff’s Office.

According to records, the two men, who were good friends, violated department policies.

The investigation started in May 2017, when the MCSO learned that Schanding and Lay were involved in the domestic battery of a female. Apparently Lay struck the female, while Schanding witnessed the altercation, but said nothing and never reported the incident.

When the incident came to light, both Schanding and Lay filed false reports in regards to the domestic battery.

According to documents obtained by Ocala Post in August, the prosecutor’s office filed Aggravated Stalking charges against Lay.

However, in order to avoid prosecution, Lay entered into an agreement with the State Attorney’s Office.

    Terms of the agreement:

    • No contact with the female
    • Submit to a mental health evaluation
    • Show proof of mental health evaluation
    • Surrender law enforcement certificate

According to the SAO, if Lay fails to comply with the agreement, he could face up to five years in prison and a $5,000 fine.

In another complaint, Schanding was also accused of purchasing prescription painkillers from Lay. No charges were filed against Schanding due to a lack of evidence.

According to an inside source, Schanding allegedly passed a drug test.

In 2013, Lay and another detention deputy were charged with Battery after assaulting an inmate. They also failed to get the inmate medical treatment in a timely manner.

    The two were eventually acquitted.

MCSO refuses to release the photo of any law enforcement officer who has been arrested or charged with a crime.

Bank of America denies cash deposits

    bank of america, cash deposits

An Ocala woman says she is disgusted with the way Bank of America (BOA) treats its elderly customers.

The woman told Ocala Post that she has been making deposits into her father’s checking account for years.

The father is legally blind and cannot drive.

She said she was shocked last week when she attempted to deposit less than $100.00 into her father’s account and Bank of America declined the cash deposit. She said the bank told her it was a new policy.

Ocala Post reached out to BOA and asked about the bank policy on cash deposits.

A spokeswoman with BOA, said, “Cash deposits to consumer checking or savings accounts are accepted only from the account owner or authorized users on the account. The security and safety of our customers’ accounts is our top priority. This change helps us reduce risks from cash transactions involving people who are not authorized on an account.  There are other options people can use to deposit money into another person’s account. For example, they can transfer money using mobile or online banking and they can make a deposit with a check at ATMs or financial centers.”

When asked about someone making deposits for the elderly, BOA stated the following:

“In addition to the [given] options, transferring money to the account via mobile/online banking or making a check deposit at ATMs or in the financial center), the member [would have to add an authorized user on the account].”

Bank of America will not accept cash deposits for non-account holders, but in 2007 expanded a program that would extend bank accounts, atm cards, and credit cards, to non-U.S. citizens who did not have a social security number. That program was later halted after the bank lost numerous customers following the announcement of the program.

We want to hear from you. What do you think of the policy?

Following a four-month-long investigation, the Florida Fish and Wildlife Conservation Commission (FWC), along with the Hillsborough County State Attorney’s Office announced charges against three fishermen in connection with a video of a shark being dragged behind a boat at a high rate of speed.

During the investigation, officials said they also learned of other disturbing images on Facebook “involving shocking disregard for Florida’s natural resources.”

“As we’ve said since this video and other images came to light, these actions have no place in Florida, where we treasure and conserve our natural resources for everyone,” said Commission Chairman Bo Rivard. “We appreciate the patience and support of the public as our law enforcement investigators worked with the Hillsborough County State Attorney’s Office to identify a number of serious violations that will be brought to the courts for adjudication. It is our hope these charges will send a clear message to others that this kind of behavior involving our fish and wildlife will not be tolerated.”

“The State Attorney’s Office is committed to holding these men accountable for having engaged in such senseless and unjustifiable animal cruelty. We thank the Florida Fish and Wildlife Conservation Commission for their work in investigating these crimes, and we stand with them, along with Florida’s fishing and hunting communities, and all those who cherish our precious natural resources, in condemning the torture of our marine wildlife,” said Andrew H. Warren, State Attorney for the 13th Judicial Circuit.

FWC officers discovered numerous criminal violations, resulting in felony and misdemeanor charges.

Quintero drove to a Red Roof Inn, located at 9922 Hawaiian Court, where he carried the woman into a hotel room and sexually assaulted her while she was drunk.

When the victim woke up, Quintero told her that she had hallucinated and had a bad dream.

The victim arrived at her destination two hours later.

    Quintero is married with children.

He is being held without bond.

This is not the first time an Orlando Uber driver has sexually assaulted a drunk female.

According to authorities, Uber remains unregulated and does not follow the same rules as cab companies when it pertains to drivers.
