Tallahassee, Florida – Today, the Senate Judiciary Committee, chaired by Senator Tom Lee (R- Brandon), passed Senate Bill 918, which advances Florida’s protection of the unborn.

Florida’s laws must keep pace with changes in medical technology,” said President Don Gaetz (R-Niceville). “As a matter of public policy, I believe the bar should be set high for elective abortions involving viable unborn children.”

Sponsored by Senator Anitere Flores (R- Miami), Senate Bill 918 maintains Florida’s current prohibition on third trimester (24 weeks) elective abortions, but requires that a physician, prior to 24 weeks, using his/her medical judgment, determine the viability of the child prior to an abortion procedure. SB 918 also provides medical exceptions to protect the mother if the termination of pregnancy is medically necessary during viability. The bill requires medically necessary abortions during viability be performed in hospital to protect both the mother and unborn child.

The United States and Florida Supreme Courts have ruled regulation of elective abortions constitutional when the child has achieved viability. Representative Janet Adkins (R-Fernandina Beach) has filed the companion bill, HB 1047, in the House.

Crystal River, Florida — On April 5, 2014, shortly after 3 p.m., Citrus County Sheriff’s deputies responded to an area behind Farmer’s Furniture in Crystal River, which is a known homeless camp, in regards to a domestic incident.

Deputies were searching for Benjamin Dick, 23, in reference to an aggravated battery where his brother was stabbed. Deputies had been actively searching for Dick since the previous evening after the incident was reported to law enforcement.

While at the homeless camp, deputies received a tip about a murder that had recently occurred. When detectives arrived on scene a witness told detectives the defendant, Dick, killed his mother and buried her in a shallow grave. Deputies searched the area surrounding the homeless camp and found what appeared to be a grave.

Based on several witness statements, detectives say the night before, Dick, along with Shannon Parker, 28, also a homeless man, were drinking with Dick’s mother, along with other witnesses at the camp site. Dick and his girlfriend had an argument and Dick began choking his girlfriend. Detectives say Dick’s mother then made some derogatory statements towards his girlfriend. Dick then started to attack his mother and the struggle led to an area behind a tent and then into a ravine. Dick strangled and also stabbed his mother several times, killing her.

Dick’s girlfriend sustained non-life threatening injuries.

After an extensive excavation, detectives found the body of Jennifer Brooks, 42 years old, mother of Benjamin Dick, in the area near the camp site. Dick was arrested on several charges including 2nd Degree Murder of his mother. Shannon Parker was arrested for his role in disposing of the body and charged with Accessory After the Fact as well as Witness Tampering.

On April 6, 2013, detectives were still processing the scene and conducting more interviews with witnesses. Commander Buddy Grant says he doesn’t know what would drive a son to kill his mother. “Our job now is to put a good case together for the State Attorney’s Office and to make sure we bring justice to this victim.”

Although detectives continue to investigate, if you have any information on this case, call 9-1-1 or you can remain anonymous and call Crime Stoppers at 1-888-ANY-TIPS.

To the Editor: High Springs Florida city attorney makes threats

ocala post, corruption, High Springs, Florida — The Police Benevolent Association was made aware of new allegations directed at Chief Steve Holley in a press release issued by the High Springs City Manger this morning. It appears that the City has opened an internal investigation into allegations against Chief Holley with regard to conduct associated with the performance of his duties as Chief of Police. The nature of internal investigations into allegations of misconduct is such that preclude public comment, specific to these issues, in an effort to preserve the elements of what should be an unbiased investigation. To that end, the PBA will reserve any comment specific to these allegations until the conclusion of the investigation and the release of its findings are made public pursuant to Florida Statute.

Allegations are just that, and should be treated with unbiased scrutiny until such time as corroborating or exculpatory evidence is uncovered. We would urge the public and the media not to pass judgment regarding these allegations until such time as the investigation is completed and its findings released. Law enforcement officers dedicate their lives to the preservation of the rights and due processes afforded to all citizens through the Constitution and state laws. They themselves are also entitled to those same protections.

Additionally, I can also confirm that this morning I personally received a letter, dated March 21, 2014, from the High Springs City Attorney which read, in part, “…This letter is written to you to demand that you immediately cease and desist any further public statements regarding the activities of the City of High Springs, City Manager Ed Booth and City Attorney S. Scott Walker, Esq.”. Additionally, the letter claimed that my previous press release statements regarding the termination of Chief Steve Holley were “an attempt to disparage or otherwise defame [Mr. Walker], this office, and the City Manager.”, and was signed “Govern yourself accordingly”. Given the threatening tone and content of the aforementioned letter, I personally find the timing of the City’s most recent press release suspect at best.

Increased Punishment For Sex Offenders In Florida Signed Into Law

    0

ocala news, ocala post, sex offendersTallahassee, Florida — On April 1, 2014, Florida Governor Rick Scott signed Senate Bills 522, 524, 526 and 528, which substantially strengthen protections against sex offenders. Protecting Florida’s most vulnerable from sexual offenders is a joint priority during the 2014 Legislative Session for Florida Senate President Don Gaetz and House Speaker Will Weatherford (R-Wesley Chapel), who both attended the bill signing ceremony.

With the stroke of Governor Scott’s pen, our state today sent a strong message – Florida is scorched earth for all those seeking to harm our children,” said President Gaetz. “This bill takes historic steps to better protect the most vulnerable among us. Now prosecutors, police, parents and communities will have the tools to effectively investigate and prosecute sexual offenders, making it less likely these vicious criminals have the opportunity to slip through the side door and re-offend.”

    Increasing Protections Against Sex Offenders

Senate Bill 522 by Senator Denise Grimsley (R-Sebring) creates an “arrest notification program” to notify DCF when an offender, previously held at the Florida Civil Commitment Center, is arrested and convicted of either a misdemeanor or felony. The bill further requires the state attorney to refer the rearrested offender for civil commitment. The legislation also allows members of the multidisciplinary team that currently evaluate offenders considered for civil commitment to consult with a state attorney, a law enforcement officer, and victim’s advocate. Additionally, SB 522 expands requirements for DCF release notifications to include the sheriff of the county in which the offender intends to reside as well as the Florida Department of Law Enforcement.

Senate Bill 524 by Senator Eleanor Sobel (D-Hollywood) requires a person be defined as a sexually violent predator and be subject to civil confinement after a finding by two or more members of a multidisciplinary team, and requires higher education institutions to tell students about a sexual predators presence on campus.

Senate Bill 526 by Senator Rob Bradley (R-Fleming Island) increases the length of sentences for certain adult-on-minor sex offenses and also prohibits incentive gain-time for offenders convicted of certain sex offenses. The legislation suspends (tolls) post-release supervision of offenders while in Department of Children and Families (DCF) custody as part of the civil commitment process and requires the court to order community supervision (split sentences) after release from prison for certain sex offenses.

Senate Bill 528 by Senator Greg Evers (R-Baker) makes a number of changes to the sex offender registry requirements. The bill creates a process for relevant agencies to be notified of an order granting a registrant’s name change petition and for informing FDLE and law enforcement agencies when a registrant whose name was legally changed fails to meet requirements for obtaining a replacement driver license or identification card. The bill also requires a registrant to report specified information on vehicles the registrant owns and vehicles owned by a person who resides at the registrant’s permanent residence, Internet identifiers (prior to their use), palm prints, passports, professional license information, immigration status information, and volunteer status at a Florida institution of higher education. SB 528 also requires registrants who are unable to secure or update a driver license or identification card with DHSMV to report any change of residence or change of name within 48 hours after the change. Further, the bill requires registrants to report information regarding their intention to establish a residence in another country.

Now that the bills have been signed, it is up to local government, judges and the state attorney to educate themselves.

Florida teachers could soon be armed with guns and open carry

    florida, teachers armed

Tallahassee, Florida — On Wednesday, April 2, 2014, a bill which would allow Florida teachers to carry loaded guns in classrooms took a huge step forward.

The new bill will allow trained school teachers, principals or volunteers to carry weapons.

According to reports, there have been 44 school shootings in the U.S since the Sandy Hook massacre. Since December of 2012, not including Sandy Hook, 28 people have died, 37 seriously injured, and many others emotionally scarred.

    Many Democrats oppose the bill.

Eric Holder and President Obama issued a warning in January, to all U.S schools, citing that they (the Obama administration) want teachers to go easy when disciplining out-of-control children, namely blacks and Hispanics. (click to read this full story)

So here is the question everyone is asking: Would armed teachers in schools really make a difference?

Statistically, the answer proves to be yes.

For instance, Arkansas, where teachers are now known as guards and are permitted to carry 9mm handguns, has had zero incidents since the policy was enacted. While there is strong opposition from the left, Florida teachers say that teachers in Utah have been carrying concealed weapons in schools for more than a decade now. The state has never had a mass shooting in its schools and has never had an accidental shooting or problems with students getting their hands on a teacher’s gun.

“Their schools are the safest and the kids are more behaved than that of students in Florida Schools,” said one Florida school official.

School officials in Utah said that budget cuts do not always permit school resource officers and that, they cannot always count on a reasonable police response time. Therefore, school officials felt it was necessary to require teachers to carry weapons.

Many states feel that “Open Carry” for teachers is the best policy.

The Department Of Justice conducted a massive survey among convicted felons. The survey asked: What deterred criminals more, armed victims or the police? The results were stunning. More than 57 percent of felons polled that criminals are more worried about confronting an armed victim than they are about the police.

Researcher Gary Kleck proved that 92 percent of criminal attacks are deterred when a gun is presented by the victim or in plain sight to criminals, without a shot ever having to be fired. Open carry has been proven time and time again to deter crime. States that have open carry such as Alaska, have an extremely low crime rate.

The gun debate is not anything new. It has been in the spotlight since the early ’80s. In 1982, Atlanta suburb Kennesaw passed an ordinance that required all households to have a gun. The residential burglary rate subsequently dropped 89 percent in Kennesaw, compared to the modest 10.4 percent drop in Georgia as a whole.

Thirty years later, the residential burglary rate in Kennesaw is still 72 percent lower than before the ordinance was passed. Proving that when criminals know a citizen is armed, they will not proceed. It mirrors that old joke, “criminals will never rob a doughnut shop because that’s where all the cops are.”

HB 753 would give school districts the option to appoint one or more people to carry a concealed weapon.

The bill doesn’t just give guns to teachers. Each district would appoint one or more person per school. Any person appointed would need to obtain a concealed weapons permit, pass a federal background check, and complete training classes.

While the bill is not for open carry, many residents say it is a start.

With many parents today not disciplining their children, leaving everything up to a teacher and allowing the Xbox to act as a babysitter, responsible parents say that change is definitely needed.

Experts say that a lack of parenting is a huge factor in the way children act today, but parents fail to see to correlation. School officials said that if more parents would take an active role in their children’s lives instead of leaving everything, including parenting roles up to teachers, then our society would be a much better place.

The next step for this bill is another committee hearing before the bill reaches the House floor.

We want to hear from you.

Do you think armed teachers will help in preventing or detouring school violence? Leave your comments below or visit this topic on Facebook.

Ocala, Florida — On April 2, 2014 at approximately 9:15 p.m., Lieutenant Turner and Deputy Terrell were parked in the 5700 block of NW 219 Street Road and could hear extremely loud music.

After approximately 30 minutes Lieutenant Turner and Deputy Terrell responded to the location in which the loud music was coming from.

Eric Brooks, 35, and other persons in the yard were asked to turn the music down that was coming from Brooks’ vehicle. Brooks was explained the laws that concern loud music and were warned to keep the volume down, especially since there is an assisted living facility within the vicinity.

Eric Brooks was at that time placed in the back of the patrol car.

According to reports, as Deputy Terrell was gathering vehicle information a huge crowd formed and bystanders began shouting and cursing at the deputy.

Suspicious Death Of Veterans Now Under Investigation

    0

    ocala post, ocala news,

Tallahassee, Florida — In light of recent reports of injuries and deaths to veterans at federal Veterans Affairs hospitals, earlier this week Governor Rick Scott called for the Florida Agency for Health Care Administration to take immediate action to shine a light on the processes of federal Veterans Affairs hospitals in Florida.

The investigation officially began today and the Agency attempted to complete an onsite review this morning at West Palm Beach VA Medical Center.

Liz Dudek, Secretary of the Agency for Health Care Administration said, “This morning, two surveyors went to the West Palm Beach VA Medical Center at 10:15 a.m. and were escorted out around 11:15 after being declined the opportunity to review any records at that time. They were told an official response would be provided from the VA’s national office in Washington D.C.”

The West Palm Beach VA Medical Center was less than cooperative with authorities, a clear indication that the hospital is covering up information that lead to the untimely deaths of multiple patients.

Multiple cancer patients have reportedly died because of delays in diagnosis or treatment through the network and many others hurt. Family members of the deceased have been left with unanswered questions. Many asking why veterans have been neglected and allowed to die after serving the United States of America.

Hospitals in Florida, South Georgia, Puerto Rico and the US Virgin Islands are under investigation.

Federal officials have refused to say in which hospitals the deaths occurred.

“Florida’s veterans who have so bravely fought to defend and protect our nation deserve quality health care, and I am disappointed in the federal government’s lack of transparency to this point,” said Liz Dudek. “We look forward to hearing back from the VA very soon so we can continue the dialogue about how the Agency can review their processes so any shortcomings can be promptly identified and addressed.”

The investigation comes just days after Senator Don Gaetz marked the signing of the Florida GI Bill, which is aimed at making Florida the most military friendly state in the nation.

    The investigation is ongoing.

Ocala, Florida — On Sunday, March 30, 2014 at approximately 1:22 a.m., officers responded to Carrington Lane Apartments located at 3001 SE Lake Weir Avenue in reference to a disturbance called in by a neighbor.

When Officer Doug Russell arrived on the scene three subjects exited the residence with blood on them. Officer Russell ordered all subjects to stop but all three subjects fled in separate directions, at which point Officer Russell radioed for backup.

Officer Russell was able to capture one of the suspects identified as Tyler Pedroza, 19, after a short foot pursuit. Suspects later identified as Daniel Guerrero, 19, and Samantha Combs, 20, were located shortly after at a residence in Fore Ranch.

The victims stated that the trio knocked on their door and, once opened, forced entry inside and began beating one of the victims.

According to reports, Guerrero pulled a knife on both victims and threatened to cut them if they called police.

During the fighting Guerrero cut his own finger with the knife, according to reports.

Combs grabbed one of the victims’ cell phone and advised that she was taking it so police could not be called. Both victims suffered minor injuries during this incident. During the incident cell phones and a wallet belonging to one of the victims was stolen.

Upon fleeing, Pedroza threw down a brown leather bag in front of Officer Russell. The bag contained a wallet belonging to one of the victims, various items of drug paraphernalia and 19 tablets of Xanax in a plastic baggie.

Rehan Lalani, 20, and Kensleigh Kotowski, 18, victims of the Home Invasion, were discovered to be destroying marijuana by putting it down the garbage disposal. The two were also found to be in possession of drug paraphernalia.

Both “victims” were less than honest about the motive of the Home Invasion, which was later learned to have been about money allegedly stolen from Pendroza by Lalani on a previous date.

Pedroza advised officers that he had contacted Guerrero and Combs in Orlando to come to Ocala and assist him in getting his money back from Lalani.

GM RecallDetroit – General Motors informed the National Highway Traffic Safety Administration today that it is now recalling more than 1.3 million vehicles in the U.S. that may experience a sudden loss of electric power steering assist.

If power steering assist is lost, a message displays on the Driver Information Center and a chime sounds to inform the driver. Steering control can be maintained because the vehicle will revert to manual steering, but greater driver effort would be required at low vehicle speeds, which could increase the risk of a crash.

Models subject to safety recall are the:

Chevrolet Malibu: All model year 2004 and 2005, and some model year 2006 and model year 2008 and 2009 vehicles

Chevrolet Malibu Maxx: All model year 2004 and 2005, and some 2006 model year

Chevrolet HHR (Non-Turbo): Some model year 2009 and 2010 vehicles

Chevrolet Cobalt: Some model year 2010 vehicles

Saturn Aura: Some model year 2008 and 2009 vehicles

Saturn ION: All model year 2004 to 2007 vehicles

Pontiac G6: All model year 2005, and some model year 2006 and model year 2008 and 2009 vehicles

Service parts installed into certain vehicles before May 31, 2010 under a previous safety recall.

Depending on the vehicle, GM will replace free of charge either the power steering motor, the steering column, the power steering motor control unit or a combination of the steering column and the power steering motor control unit. Customers who previously paid for repairs of these parts would be eligible for reimbursement.

In addition, 309,160 non-turbocharged Chevrolet HHRs from the 2006-2008 model years (and several hundred 2009 models) and 96,324 Saturn IONs from the 2003 model year that are not subject to these recalls will be given lifetime warranties for replacement of the electronic power steering motor.

“With these safety recalls and lifetime warranties, we are going after every car that might have this problem, and we are going to make it right,” said Jeff Boyer, vice president, GM Global Vehicle Safety. “We have recalled some of these vehicles before for the same issue and offered extended warranties on others, but we did not do enough.”

The 2004-2007 Saturn ION, the 2009-2010 Chevrolet HHR and the 2010 Chevrolet Cobalt are included in previously announced recalls for ignition switches that may not meet GM specification for torque performance. Repairs for the ignition switch and power steering assist may require separate dealership visits depending on parts availability.

GM expects to take a charge of up to approximately $750 million in the first quarter, primarily for the cost of recall-related repairs announced in the quarter. This amount includes a previously disclosed $300 million charge for three safety actions announced on March 17 and the ignition switch recall announced February 25, 2014.

A Wisconsin State Patrol police officer looks through the wreck of a 2005 Chevy Cobalt in St. Croix County, Wisconsin in 2006 that resulted in fatalities.

It took 10 years for GM to admit there was a problem, and although GM initially denied the defect had caused any fatalities; today GM confirmed that 13 people have been killed in traffic crashes as a result of GM failing to swiftly recall the ignition switch defect.

Experts say GM is misleading the public by downplaying the amount of fatalities that have actually taken place. Reports indicate the death toll could be as high as 300 people over a 10 year period, however authorities are having a difficult time proving the data. Authorities say GM engineers covered up black box data recovered from crashed vehicles that could have proven the ignition switch has been the result of many accidents as well as fatalities. The first black box data that proved that the ignition switch had failed and caused a 2006 crash that killed a family was not reported and withheld from authorities in 2009.

GM Chief Executive Officer Mary Barra’s written testimony was submitted today to the House Committee on Energy and Commerce Subcommittee on Oversight and Investigations. Her testimony addresses the GM Ignition Switch Recall and answers the question: “Why Did It Take So Long?” Barra is scheduled to give oral testimony on Capitol Hill tomorrow afternoon, April 1, 2014 and on April 2, 2014.
