    AT&T Mobility, LLC, has been ripping off customers

    AT&T, FTC, sued, verizon

    The Federal Trade Commission filed a federal court complaint against AT&T Mobility, LLC, charging that the company has misled millions of its smartphone customers by charging them for “unlimited” data plans while reducing their data speeds, in some cases by nearly 90 percent.

    The FTC’s complaint alleges that the company failed to adequately disclose to its customers on unlimited data plans that, if they reach a certain amount of data use in a given billing cycle, AT&T reduces – or “throttles” – their data speeds to the point that many common mobile phone applications – like web browsing, GPS navigation and watching streaming video – become difficult or nearly impossible to use.

    “AT&T promised its customers ‘unlimited’ data, and in many instances, it has failed to deliver on that promise,” said FTC Chairwoman Edith Ramirez. “The issue here is simple: ‘unlimited’ means unlimited.”

    According to the FTC’s complaint, AT&T’s marketing materials emphasized the “unlimited” amount of data that would be available to consumers who signed up for its unlimited plans. The complaint alleges that, even as unlimited plan consumers renewed their contracts, the company still failed to inform them of the throttling program. When customers canceled their contracts after being throttled, AT&T charged those customers early termination fees, which typically amount to hundreds of dollars.

    The FTC alleges that AT&T, despite its unequivocal promises of unlimited data, began throttling data speeds in 2011 for its unlimited data plan customers after they used as little as 2 gigabytes of data in a billing period. According to the complaint, the throttling program has been severe, often resulting in speed reductions of 80 to 90 percent for affected users. Thus far, according to the FTC, AT&T has throttled at least 3.5 million unique customers a total of more than 25 million times.

    “It’s absolutely outrageous,” said John Bergmayer, a senior staff attorney at Public Knowledge, an advocacy group based in Washington. “They’re not allowed to promise one thing and deliver another… Unlimited is not unlimited when you put limits on it.”

    Consumers in AT&T focus groups strongly objected to the idea of a throttling program and felt “unlimited should mean unlimited.” AT&T documents also showed that the company received thousands of complaints about the slow data speeds under the throttling program. Some consumers quoted the definition of the word “unlimited,” while others called AT&T’s throttling program a “bait and switch.” Many consumers also complained about the effect the throttling program had on their ability to use GPS navigation, watch streaming videos, listen to streaming music and browse the web.

    The complaint charges that AT&T violated the FTC Act by changing the terms of customers’ unlimited data plans while those customers were still under contract, and by failing to adequately disclose the nature of the throttling program to consumers who renewed their unlimited data plans.

    FTC staff worked closely on this matter with the staff of the Federal Communications Commission.

    The Commission vote authorizing the staff to file the complaint was 5-0. The complaint was filed in the U.S. District Court for the Northern District of California, San Francisco Division.

    The lawsuit marks the second time this year that a major wireless carrier has been targeted for its treatment of customers on unlimited data plans. In July, the FTC criticized Verizon over a plan to throttle heavy users during periods of peak congestion. Verizon later backed down on that plan. The FCC said Tuesday that it was coordinating with the FTC on investigations into carriers slowing down unlimited data.

    AT&T called the lawsuit meritless.

    The Commission files a complaint when it has “reason to believe” that the law has been or is being violated and it appears to the Commission that a proceeding is in the public interest. The case will be decided by the court.

    The Federal Trade Commission works for consumers to prevent fraudulent, deceptive, and unfair business practices and to provide information to help spot, stop, and avoid them.

    Ocala, Florida — An Ocala woman that was dating a criminal she knew was a wanted felon, is now a felon herself after she attempted to elude Ocala police.

    Ocala Police Officer, Jeffrey Hall, was traveling northbound on NW 1st Avenue when he saw a dark blue Lincoln traveling eastbound on NW 28th street run the stop sign at NW 1st Avenue and NW 28th Street.

    Officer Hall then increased his speed in order to catch up with the Lincoln. As the officer got closer, he recognized the vehicle as belonging to Lacie Watson, 19, girlfriend of wanted felon, Icentceion Thomas, 24, who was a passenger in the vehicle. Thomas was wanted on an outstanding warrant from the Marion County sheriff’s Office.

    At that point, Officer Hall activated his emergency lights.

    The vehicle then turned northbound on NE 4th Court, into Deer Run Apartments and continued northbound through the complex without yielding at several safe locations to stop. The vehicle also increased its speed, failing to slow down for several speed bumps.

    Halfway through the complex the vehicle came to an abrupt stop, at which point the rear driver’s side door opened; Thomas then jumped out and fled on foot.

    By this time, Ocala Police Officer, Joseph Kelly, had arrived on the scene. Officer Hall and Kelly exited their patrol vehicles and pursued Thomas on foot. He was apprehended in a nearby wooded area.

    Upon returning to their patrol cars, they realized Watson had driven away from the scene.

    K-9 Officer Casey Walsh located the vehicle parked in the very back of the complex. When located, two females were walking away from the vehicle — one was identified as Watson.

    Officers told Watson she should not have driven away from the traffic stop, to which Watson replied, “I didn’t know I had to stay.”

    K-9 Officer Walsh utilized “Babbo,” her K-9 partner, and conducted an open air drug sniff on the vehicle. Within seconds, the K-9 alerted on the vehicle.

    Upon searching the vehicle police found a Crown Royal bag that contained cocaine and a duffle bag that contained marijuana. Everything was placed into evidence, along with dashcam video that recorded Watson leaving the scene.

    Thomas was charged with Possession of Cocaine, Possession of Marijuana, Resisting Arrest, and Battery for his outstanding warrant.

    He has previous arrests for Possession of Cocaine (x2), Distribution of Cocaine, Possession of Marijuana, and Resisting Arrest.

    Watson did not have a previous arrest record in Marion County.

    Watson had previously been questioned about Thomas’ whereabouts and she denied knowing where he was. She told investigators that she had not seen him for several weeks.

    On October 28, 2014, Thomas was booked into the Marion County jail where he remains.

    Watson bonded out on $5,000, 53 minutes after being booked.

    Tallahassee, Florida — Students Working Against Tobacco (SWAT), the statewide youth-led movement, announced the names of its new Youth Advocacy Board members.

    The Youth Advisory Board works in collaboration with the Florida Department of Health’s Bureau of Tobacco Free Florida to help plan the direction and goals of the SWAT organization and of the youth prevention component of the state’s tobacco control campaign. Students work with county grantees on a local level to support initiatives that educate others about tobacco use, help protect youth from tobacco, and strengthen local policies, especially those that protect the public from secondhand smoke.

    “Youth advocates are the next generation of leaders in Florida and across the country,” said State Surgeon General and Secretary of Health Dr. John Armstrong. “These enthusiastic students work diligently with a passion to create positive change and raise awareness among their peers and community about the dangers of tobacco use.”

    SWAT aims to empower, educate, and equip Florida youth to revolt against Big Tobacco. SWAT is a movement of empowered youth working together to de-glamorize tobacco use. Their efforts aim to shape tobacco-free norms, make tobacco less desirable, less acceptable, and less accessible.

    Ocala, Florida —An Ocala woman was arrested after she failed to comply with the terms of her felony probation following her arrest in May 2014.

    It all started on May 13, 2014, when Ocala Police responded to Shuckers Oyster Bar on SW 16th Street, after receiving a call about an impaired driver. The caller stated that a female, who was believed to be intoxicated, was driving a white Jeep.

    When an officer arrived, the white Jeep was parked in the rear of the businesses parking lot, but was unoccupied.

    The officer left the area and parked across the street to close out the call. As he began to pull back onto SW 16th Street, he noticed the white Jeep exit the parking lot.

    The driver of the Jeep spotted the OPD officer and attempted to make several turns and drive through business parking lots in an attempt to avoid the officer.

    The Jeep ended up westbound on State Road 200. The Jeep was observed drifting from side to side, crossing over the lane divider, straddling the line. As the driver approached SW Martin Luther King Avenue, the Jeep abruptly changed lanes into the outside lane while passing another vehicle, then immediately pulled into the parking lot of a Citgo located at 1517 SW 10th Street.

    Due to traffic, the officer could not safely follow the driver into the parking lot. Therefore, the officer drove to Jenkins Hyundai of Ocala and turned around.

    According to the officer, as he approached the Citgo, the driver of the Jeep, identified as Karli-Jo Heath, 21, was standing in the parking lot smugly waving at the officer.

    When the officer made contact with Heath and asked if she had been drinking, she stated she had not. However, the officer claimed he could smell a very strong odor of alcohol emitting from her person and breath every time she spoke.

    While instructing Heath to perform a sobriety test, she attempted to walk away. The officer ordered her to stop, but she continued walking into the store; the officer then followed.

    Despite several verbal orders, Heath refused to listen to the officer. The officer advised he would place her under arrest for obstruction if she did not comply, but Heath continued to walk away while inside the store.

    The officer then grabbed Heath’s left wrist and attempted to place handcuffs on her. Heath then began punching the officer in the torso as she attempted to pull away.

    The officer then pinned Heath against a display in the store so he could radio for backup. While he had her against the display, she began kicking the officer in his right shin. According to reports, the officer then released Heath, drew his Taser, and ordered her to put her hands behind her back or he would be forced to tase her.

    Heath then placed her hands behind her back and was handcuffed.

    Once outside, Heath began fighting officers while she was handcuffed. She kept pulling away while a female officer attempted to search [her].

    Heath had to be hobbled and placed into the back of a patrol car. She was then transported to the Marion County Jail.

    While at the jail, Heath refused to submit to a blood alcohol level test. She began yelling, “I was not driving. I was just standing on the sidewalk.”

    Heath was charged with Battery on a Law Enforcement Officer (F), Resisting an Officer with Violence (F), Operating a Motor Vehicle with a Restricted License, Refusal to Submit to B.A.L. Test, and DUI.

    Heath now faces charges of Violation of Probation.

    Heath’s May arrest was her second DUI. She was previously arrested in December 2013 for DUI. This is also her second time violating her probation.

    She was released on $12,500 bond.

    Ocala man killed by car on SW 60th Avenue

    Ocala, Florida — Family and friends are mourning the loss of 41-year-old David A. Santavicca after he was struck and killed early Monday morning as he walked along SW 60th Avenue.

    According to the Florida Highway Patrol, shortly after 5 a.m., Santavicca was walking within the right lane of SW 60th Avenue in the path of a 2004 Chevrolet Cavalier driven by Phillip Kyle Hashagen, 51, of Ocala.

    Reports stated that Hashagen was traveling north on SW 60th Avenue and was unable to avoid the collision with Santavicca. The right front of the Cavalier struck Santavicca.

    Corporal Shaun Lattinville, of the Florida Highway Patrol, reported that Santavicca was wearing all dark clothing.

    Marion County Fire Rescue pronounced Santavicca dead at the scene.

    The results of the driver’s blood alcohol test are pending, as are the charges in this accident.

    Many unanswered questions after Ocala teacher committed suicide

    Ocala, Florida — First Assembly Christian School (FACS), a local private school, was left looking for answers on Wednesday after one of their third-grade teachers committed suicide following allegations of sexual abuse on his stepdaughter.

    The girl alleges that her stepfather had been abusing her on and off for several years. She said that at the age of seven (7), her stepfather introduced her to “porn.” She said her stepfather played a video that depicted a girl performing oral sex on a man. She alleges that over the course of the next several years, she performed oral sex on her stepfather multiple times; mainly when no one was home.

    The girl told investigators that it most recently happened when her mom was away on business.

    After being asked, Ocala Post investigated these allegations of sexual abuse. Information was gathered from the alleged victim’s family, friends, police reports, and the probable cause affidavit.

    The following is a detailed timeline of the events leading up to the suicide.

    On October 13, 2014, Ocala Police Officer, Dale Parish, responded to Munroe Regional Medical Center in reference to allegations of sexual assault on a 12-year-old girl. The RN on duty reported that the girl was recently brought in under a Baker Act because the girl claimed she had attempted to kill herself. The girl told the RN her stepfather, Joel Ken Taylor, 52, had been sexually abusing her for the last several years and that was why she allegedly tried to harm herself. Upon hearing this, hospital staff asked Taylor, who was at the hospital with his wife and daughter, to leave the immediate area. OPD was then notified.

    The girl alleged that her stepfather showed her a pornographic film one time when she was seven (7). She said that is when the molestation involving oral sex began.

    The girl stated that on Sunday, October 12, 2014, Taylor had abused her while her mother was in Texas on business and her sister was at work.

    According to family members, Taylor normally accompanied his wife on all of her business trips; however, on this particular weekend, his stepdaughter was grounded for lying and being disrespectful to her parents.

    According to the police report, during the interview process, the victim changed her story several times. In one instance, reports state that she changed the day of incident from Sunday to Saturday, but gave similar accounts of the incident. She said she changed it to Saturday because they had a normal Sunday of watching TV after church, and they had even ordered a pizza. Her mother also returned home on Sunday.

    The victim told the officer that she woke up around midnight on October 12, 2014, because she had a bad dream about her own funeral.

    The girl stated that when she woke up she took approximately 20, 25mg Topamax pills (a pill used to treat seizures and migraine headaches), along with half a bottle of 100 count, 220mg Aleve. She stated that once she took the pills she was up all night. She later changed her story while being interviewed by a second investigator, and said that she took the entire bottle of Aleve.

    Officer Parish reported, “While interviewing the girl she did not show any signs of emotional distress, she talked about the incident with ease, and did not shed a tear. She seemed to be happy, and was smiling during the interview.”

    According to reports, when the officer asked her about specific dates and times, she could not provide times or even approximate dates. She then claimed Taylor last molested her three (3) to four (4) weeks ago. She went on to say that Taylor “grinded” on her while he was naked. She later changed her story to Taylor being fully clothed.

    Officer Parish then explained the ramifications of providing false statements or making a false police report. Officer Parish then asked if Taylor had done anything to any of her other sisters or anyone else, to which she stated, “No.”

    During this time, Taylor and his wife were kept separated at the hospital. After interviewing the girl, Officer Parish interviewed the girl’s mother.

    She stated the allegations were a complete shock to her. She said everything had been fine, and that her daughter had transferred from FACS to Fort King Middle for the 2014-2015 school year, and since the change, her daughter had been acting out. She stated that her daughter was making friends with less than desirable people, and she had been hanging out with a girl whom she and Taylor had caught in many lies. She had recently told her daughter that she did not want her associating with her new friend, and because of her behavior, she was forbidden to talk to her friend. This occurred on the weekend of the alleged sexual abuse.

    The mother stated she had dropped her daughter off at Fort King Middle that morning, and she was later contacted by the school and told her daughter had been placed under a Baker Act.

    The mother also stated that her daughter might be acting out due to recently starting her menstrual cycle during the summer.

    Officer Parish then interviewed the victim’s sister, who stated that Taylor had never tried anything and was shocked at the allegations. She corroborated her mother’s information regarding her sister’s recent behavior.

    After interviewing the victim’s sister, Officer Parish again spoke with the RN who handled the victim’s care. The RN informed Officer Parish that the victim’s toxicology report showed no signs of elevated levels, which would indicate she had taken a large amount of Aleve as the victim had previously stated.

    Detective Rowe then responded to the hospital and took over the investigation.

    Detective Rowe interviewed the victim and she stated that her parents were not happy with her about her new friends, and she had argued with them the day before. Unaware of the results of her toxicology report, she told the detective that she had taken an entire bottle of Aleve instead of half, and at least 20 Topamax pills. She said she did it because of what her stepfather had done to her.

    The victim told investigators that she wanted her mom to divorce her stepfather and she wanted him to move out.

    Detective Rowe then interviewed Taylor. Taylor also told the detective he was completely shocked by the allegations.

    Taylor told Detective Rowe that his stepdaughter’s behavior had dramatically changed after being pulled from FACS and placed into Fort King Middle School.

    Taylor said his stepdaughter began hanging out with a group of friends that he and his wife believed were a bad influence. Taylor stated that her new friends, one in particular, would tell lies so she could spend more time at their home with his stepdaughter. Taylor also claimed the friend gave one of their neighbors the middle finger and got into a verbal argument with them. Taylor stated that his stepdaughter had been getting into a lot of trouble recently, and they had to speak with her several times about her behavior. Taylor said she was refusing to do chores and wouldn’t listen.

    Taylor told Detective Rowe that he had absolutely not been involved in any sexual activity with his stepdaughter and was completely surprised by the accusations.

    Detective Rowe asked if he would be willing to take a polygraph to prove his truthfulness, to which Taylor agreed.

    When Taylor learned of the allegations against him, he himself notified the school where he taught third grade. The school immediately removed him from his teaching position pending the outcome of an investigation.

    On October 14, 2014, Detective Rowe was contacted by Taylor’s other stepdaughter, who resided out of town, after learning of the allegations.

    Friends and family members told Ocala Post this other stepdaughter disliked Taylor because he was very strict, and liked to control everything.

    She told Detective Rowe that she only visited approximately once a month, but noticed a change in her sister’s behavior. She stated that she previously lived with Taylor, but he was too controlling, and her sister would do whatever he told her to do. She said she believed that her sister’s behavior was because of Taylor. She stated that she was never touched by Taylor, but believed her sister might have been. She stated that she felt her sister would be better off with her biological father.

    However, the victim described her biological father as mean and told her mother she did not like visiting him because she did not get along with his new wife or her step mother’s children.

    According to family and friends, Taylor was retired military and he and his wife ran a “tight ship” at home. They believed in being strict.

    Taylor told investigators he had forbidden his daughter to date at the age of 12, and had recently found out she had a boyfriend. Taylor’s wife also told investigators that her daughter was not allowed to date.

    Taylor believed that her secret boyfriend could have also been one of the causes of his stepdaughter’s behavioral problems.

    The victim was again interviewed on October 17, 2014 — this time by Kimberly’s Center for Child Protection. She told officials there would not be any physical evidence around the home. She also stated that during the sexual abuse, Taylor would “backhand” her to gain compliance. She claimed she had never told anyone about the sexual abuse until now. She stated that Taylor only made her watch a pornographic film one time, and she has not observed any other films around the house.

    According to family and friends, the victim never showed signs of bruising or marks on her face, which would be consistent with a backhand.

    When asked if there were any nude photos or inappropriate phone messages shared between Taylor and herself, she stated, “No,” but again claimed he had sexually abused her.

    On October 21, 2014, Detective Rowe again interviewed Taylor’s wife. She told investigators that her daughter was a cheerful girl who was typically well-behaved and made good grades. She stated that recently her daughter had told lies in order to be able to spend time with friends, but she never expected the current allegations.

    She stated that her husband and daughter always had a great relationship and there had never been any problems other than the fact the girl thought her stepfather was too strict.

    When asked if her daughter had access to pornographic material, she said, “No.” She stated that their home computer is strictly monitored and she routinely checks her daughter’s cell phone. She told detectives that they did not allow their children to have personal computers — they only shared a family computer, centrally located so it could be monitored at all times — internet usage was strictly monitored. The children were never allowed to watch anything over PG-13, nor were they allowed to sit around and play video games all day.

    She again told the detective that she was having a very difficult time believing the accusations.

    The detective asked if she knew why her daughter would make up something like this, to which she stated that she believed it was because their daughter wanted to be homeschooled and they would not do it.

    On October 21, 2014, Detective Rowe made contact with Taylor to schedule the polygraph test. Taylor’s attorney, however, would not allow it. Taylor’s attorney actually forbid him any further contact with detectives.

    Taylor’s son as well as attorney had encouraged him to fight the sexual abuse allegations .

    On October 22, 2014, Detective Rowe completed a probable cause affidavit to arrest Taylor for the offenses of Sexual Battery on a Child 12 years old or Older.

    At 10 a.m., Detective Rowe contacted Taylor via telephone, notifying him of the charges, and requested he respond to the Ocala Police Department. Taylor advised he would.

    Shortly after Detective Rowe spoke with Taylor, the law firm of Blanchard, Merriam, Adel, & Kirkland, P.A. contacted Detective Rowe and informed him that he was to cease contact with their client Mr. Taylor. The law firm then requested to know the charges, and informed the detective that Taylor would turn himself in.

    Pastor Jeff Wade, from FACS, had planned to be Taylor’s transport to OPD.

    Taylor was with his wife, at a home he had been staying at, when he learned that charges were actually being filed. Taylor’s wife then called his 27-year-old son, and told him he should come visit with his father before he was taken away. His son arrived a short time later. The family was in disbelief. Taylor’s wife and son told him they would fight the charges together.

    As Taylor and his son were talking outside, Taylor said, “I refuse to be arrested.” When his son asked why, Taylor replied, “Once someone is arrested on child molestation charges, they stick for life.” His son then told Taylor they would fight the charges and not to do anything stupid.

    Taylor said he had been removed from school and taken away from what he loved doing most — teaching. He said he did not want a good school to be dishonored by false accusations, and the accusations would follow him around forever. Taylor said it was not fair to his family, the school, or himself.

    Taylor told his son that the charges were ridiculous and he refused to be labeled as a child molester. His son said they talked, prayed, and then he (Taylor’s son) went into the house and said to his mother, “I hope he doesn’t do anything stupid.”

    Less than 30 seconds later, they heard a gunshot. Taylor died from a self-inflicted single gunshot wound to the chest.

    Pastor Wade arrived a short time later.

    Police found two typewritten suicide notes — one to his family, and the other his eulogy and burial wishes.

    In the note to his family, Taylor wrote that he is not a coward, but an honorable man and will not be labeled as a child molester. He wrote that he refused to drag his family through the court system on the allegations. He wrote that he felt it would be better for his family if he left this world.

    Taylor maintained his innocence in the suicide note.

    According to the American Humane Association, sexual abuse is all about secrecy. They say when sexual abuse occurs, the child victim may be the only witness and the child’s statements may be the only evidence. In this case, there was no physical evidence, so investigators were relying on the victim’s statements. They also rely on various methodical interview techniques to determine fact from fiction. In such cases, the central issue sometimes becomes whether the child’s statements can be trusted. Some child welfare experts feel that children never lie about sexual abuse and that their statements must always be believed. On the other end of the spectrum, even if physical evidence is present, victims of sexual abuse sometimes deny the abuse ever occurred.

    In this case, because Taylor took his own life, the case has been deemed closed. The circumstances surrounding this incident has shattered multiple lives, and left many, including students of FACS, asking questions that might never be answered.

    Grievance counselors believe that during the two week investigation, Taylor slipped into a deep depression, which ultimately led to his suicide.

    First Assembly Christian School released the following statement:

    “The death of teacher, church member, and friend Ken Taylor has understandably been a painful tragedy for First Assembly School and Church. We grieve the loss of a man who we only knew as a dedicated instructor and faithful part of this congregation.

    During his entire time as a teacher at our school, Ken had a flawless employment record.

    To date, we have not been contacted by the police to make a statement about Ken or his record here. We continue to be ready to cooperate in any investigation they are conducting.

    We regret the recent story in the Ocala Star Banner, which we feel misquoted our pastor several times. We encourage anyone reading the Star Banner article to realize it is not an accurate picture of Ken or his record with us.

    Police report sheds light on the Treon Harris accusation

    Gainesville, Florida — The University of Florida released the full police report of the Treon Harris rape accusation; two weeks after a female student accused him of rape and later withdrew the complaint.

    According to the report, a female student said to campus police that Harris used his body weight to hold her while she tried to escape and repeatedly protested. According to documents, Harris later texted her, “Don’t tell nobody bout nothing.”

    Police interviewed Harris less than 36 hours after the incident, Harris said that he indeed did have sex with the student but denied that he raped her. Harris said he sent the text message because he did not want another woman to find out about the encounter with the female student.

    The accuser reported the incident after midnight on October 6th, saying the incident occurred about 2 a.m. on October 5th. The University of Florida suspended Harris on October 6th but later reinstated him on October 9th after the accuser withdrew her complaint.

    On Wednesday, Florida Gators Coach Will Muschamp told reports that Treon Harris would start against Georgia on November 1st.

    More than 60 pit bulls rescued from two Florida homes

    Polk County — Investigators with the Polk County Sheriff’s Office said it was a bloody scene when they served search warrants on two home’s — one located at 122 Dr. Martin Luther King Jr. Street, Fort Meade, Florida and the other at 880 L B Brown Avenue, Bartow, Florida — on October 22, 2014.

    Investigators said they recovered more than 60 pit bulls that were being used in dog fighting rings. More than 10 of the dogs had thick logging chains around their necks, which were too heavy for the dogs. This method is used to strengthen a dog’s neck for fighting.

    According to reports, the dog fighting rings had wooden and concrete walls with a carpeted floor. There was even a spectator area set up—complete with chairs. Investigators said the carpet was covered in blood, and blood smears were up and down the walls.

    Investigators said as the dogs were being removed from the property, they were extremely aggressive due to the way they had been trained. Many of them had injuries consistent with dog fighting.

    Along with the dogs, investigators seized more than 20 grams of marijuana, weapons, drug paraphernalia, dog fighting equipment, and “Team Pitbull” T-shirts that were being sold. Everything, including the bloodstained carpet, was collected and placed into evidence.

    According to investigators, this is one of the worst dog fighting rings they have ever discovered.

    Hewitt Grant II, 47, and Nicole “Nickie” Sanders, 44, were arrested and Charged with Aggravated Animal Cruelty(x12), Possession of an Animal for use in a Fight (x61), Possession of Animal fighting Equipment (x3), Possession of a Firearm by a Convicted Felon (x2), and Possession of Real Estate Property for use of Dog Fighting.

    Hewitt had an existing injunction against him from 2006, forbidding him to be in possession of an animal.

    Chief Martin, with the Polk County Sheriff’s Office, said, “Grant has been in and out of jail multiple times in the past, and several of those times were about dog fighting. He’s proven he has no regard for animals and now he’s in jail where he belongs.”

    Mother and daughter murdered, killer now dead

    Ocala, Florida — Murder suspect, Ricardo De Jesus Barrera, passed away last night, October 21, 2014, at 8:05 p.m. at UF Health Shands Hospital, Gainesville, Florida.

    On October 20, 2014, at approximately 2:56 p.m., officers from the Ocala Police Department were dispatched to a disturbance at Springwood Village Apartments, 1525 SE 25th Street, Ocala.

    As officers arrived on scene, information was received of multiple shots being fired and that the suspect had fled on a motorcycle. Officers observed the suspect’s motorcycle fleeing the apartment complex at a high rate of speed; one officer gave chase and the other proceeded to the scene. The motorcycle continued to flee from officers going north on SE Lake Weir Avenue, and then east on SE 17th Street.

    During the course of the pursuit, shots were fired involving OPD officer, Lieutenant Daniel Wilson, and the fleeing murder suspect crashed.

    The suspect was then transported to a local hospital.

    As per Department Policy, Lieutenant Wilson was placed on paid Administrative Leave pending the investigation by the Florida Department of Law Enforcement (FDLE) and OPD’s Professional Standards Section. No other information regarding this portion of the incident is available for release at this time.

    Back at Springwood Village Apartments, officers located two deceased females. Also on scene, and present at the time the shootings occurred, was a 6-year-old female and a 22-month-old male – neither were physically injured.

    Bonnie-Lyn had a total of three children, Barrera is the father of one of the children.

    On October 18, 2014, police responded to the Barrera residence in reference to a domestic dispute. Barrera was yelling at the children and had locked them in their bedroom after breaking many of their belongings. Bonnie-Lyn ran outside and dialed 911. Bonnie-Lyn told dispatch the Barrera had been irate all day and she was scared. Police diffused the situation and left the area.

    Bonnie-Lyn and Barrera were living together at the time of the argument. After the argument, Bonnie-Lyn packed up her children and went to stay with her parents, who lived in Springwood Village Apartments.

    On October 19, 2014, Bonnie-Lyn awoke to find that all of her car tires had been slashed. An incident report was filed with OPD at 5 a.m. on the morning of the incident.

    Reports indicate that Bonnie had gone to the courthouse on the morning she found her tires slashed to get a restraining order against Barrera, but it was denied. Despite Barrera’s previous actions toward the children and the tire slashing incident, the courthouse told Bonnie that since Barrera had not threatened her or harmed anyone, they could not issue the order. According to the Clerk of the Court, the deputy clerk that helped Bonnie-Lyn told her that she could take the petition to a judge, at which time Bonnie-Lyn declined. According to the Clerk of the Court, Bonnie-Lyn then left the courthouse.

    On the day of the shooting, Barrera returned to Springwood Village apartments two (2) separate times — each time arguing with Bonnie-Lyn. Barrera then returned to the apartment complex a third time, argued some more, then shot Bonnie-Lyn and her mother, Julia Marie Motto, 67. Barrera was positively identified as the shooter.

    Bill Motto, husband to Julia and father to Bonnie-Lyn, is devastated. The father described Barrera as a hot-headed lunatic.

    Bill Motto last saw his daughter at the courthouse on the morning of the shooting. He had gone to pick the third child up from Pre-K, when arrived home, he saw police everywhere.

    “I knew they were dead. I knew at least my wife and daughter were dead,” said Bill Motto. “He’s a lunatic. She should’ve known better. But where could she hide?”

    Bonnie-Lyn did everything for her mother and father — drove them everywhere. Now, Bill Motto — the father, husband and grandfather — is left alone.

    Bonnie-Lyn’s three children are being cared for by family members.

    Teens identified in 90 burglaries, photos released

    Ocala, Florida — At around 8 a.m., Saturday, October 18, 2014, Marion County Sheriff’s deputies responded to the 3400 block of S.W. 165th Avenue Road, Ocala, in reference to a residential and vehicle burglary.

    After further investigation, detectives arrested and charged 18-year-old Zach St. Pierre and two juveniles — 15-year-old Michael Dawson and 16-year-old Alan Page — with six counts of Burglary and Grand Theft.

    Deputies made contact with the victims, who said close to $1,300 of property and cash was taken from their garage and car.

    Fresh shoe impressions were at the scene, which prompted deputies to canvas the area for suspects.

    St. Pierre was riding his bike heading south on 165th Avenue Road when deputies spotted him.

    Deputies were able to match his shoe prints to one of the impressions taken from the victim’s yard. St. Pierre said Dawson and Page were also involved, and took detectives to several locations that they burglarized together.

    According to the Marion County Sheriff’s Office, St. Pierre and Dawson admitted the trio are responsible for 80 to 90 burglaries in the area.

    Dawson and Page took deputies to their homes, where deputies say the two had most of the stolen items taken during their burglary spree stashed in their bedrooms. Additionally, stolen items were found at St. Pierre’s residence and a stolen handgun was found in Dawson’s bedroom.

    According to reports, all three suspects’ footprints were exact matches to the ones found at Saturday morning’s crime scene.

    Due to the magnitude of the crime spree, more charges are expected.

    Inverness, Florida — Convicted felon, Michael Paul Watkins, 41, of Inverness, was taken into custody by federal agents with the Bureau of Alcohol, Tobacco, and Firearms (ATF) today.

    Watkins is the owner of Ridin’ Dirty Motor Sports and Cool Aid Heating and Air in Citrus County.

    This morning, the Citrus County Sheriff’s Office assisted the ATF with serving a search warrant at Ridin’ Dirty Motor Sports on E. Gulf to Lake Highway in Inverness.

    The investigation began after an anonymous tip led investigators to believe that Watkins was in possession of explosives (grenades) and possibly weapons.

    The Citrus County Sheriff’s Office and the ATF also served search warrant on Watkins’ house. Investigators said his home was built like a bunker, with a gated concrete wall around the entrance of the home, and rolling steel shutters on the front door and windows.

    Family of Watkins has threatened a defamation of character lawsuit against the Citrus County Sheriff’s Office, and didn’t want Watkins’ information or pictures of his home on the internet. However, the State Attorney said defamation and slander lawsuits can only be filed if the allegations or statements made against a person are false, and in this case, they said, the allegations are 100 percent factual. Additionally, in Florida, arrest information, including all reports, are public record.

    There have also been allegations that Watkins might have been selling grenades and weapons to the public; however, those allegations have not been confirmed.

    Previous customers of the two businesses say that Watkins has been doing dirty business since he opened his doors. Complaints against Watkins’ businesses are stacked quite high.

    Many have turned to social media, calling his arrest karma.

    Watkins faces charges of Possession of a Firearm by a Convicted Felon and Possession of a Destructive Device.

    The ATF has taken the lead in the investigation.

    No further details about the arrest are being released at this time.

    The federal investigation is ongoing.

    The news report floating around social media, which claims Ebola has been confirmed in Ocala, is a hoax.

    One of the posts revealed it was a prank when the link within the post was clicked on, while another circulating does not.

    Authorities said there have not been any cases of Ebola in Ocala.

    Health officials also said Ebola is not a joking matter.

    Authorities said instilling fear by creating fake news alerts and social media posts — regardless if it was meant as a prank — will not be tolerated.

    Authorities said no charges have been filed at this time, but they are monitoring the situation closely.

    Be advised the Ocala Police Department is currently working a homicide scene with two persons deceased and a related crash with an officer involved shooting. The homicide scene is at Springwood Village Apartments, and the crash scene is in the 1600 block of SE 17th Street.

    Free Food Day event at Ocala Public Library

    Ocala, Florida — Children ages 4 through 9 can enjoy interactive games, sing-a-longs, reading, and crafts while learning about the importance of good nutrition and physical activity at the free Food Day event at the Headquarters-Ocala Public Library, 2720 E Silver Springs Boulevard, Ocala.

    This free event is scheduled for Friday, October 24, 2014, at 2 p.m. Sponsored by the Florida Department of Health in Marion County and the Marion County Public Library, the event celebrates Food Day, a nationwide celebration that inspires Americans to change their diets and our food policies.

    “It’s never too early to teach children how to make healthy choices when it comes to the food they eat,” said Meaghan Crowley, Health Education program manager at the Florida Department of Health in Marion County. “We want to teach kids that the foods they choose can help them grow strong and healthy, and let them have fun while learning.”

    Plane and human remains found in Ocala

    Ocala, Florida — A man walking through the woods at the Pruitt Trailhead found the site of a plane crash along with skeletal remains. The plane was last known to be piloted by Theodore Weiss, 74, who went missing with his plane on April 5, 2014.

    The Marion County Sheriff’s Office has not yet confirmed the remains that were found are those of Weiss, but suspect it is. His skeletal remains were still buckled into the pilot seat.

    Weiss was last seen departing from the Dunnellon Airport on Saturday, April 5, 2014, and never arrived at his destination in Zephyrhills. The plane found last night, October 19, 2014, does belong Weiss. It is a white experimental type, two seat, low wing aircraft with a green stripe and “N229P” on the tail section.

    The Civil Air Patrol attempted to track Weiss’ flight after he was reported missing on April 7, 2014, and provided last known coordinates near Trail 10 in a portion of the Withlacoochee State Forest in Citrus County. Based on information provided by the Civil Air Patrol, Citrus and Hernando County Sheriff’s Offices began their search on the evening of April 7th, over 40,000+ acres.

    The NTSB and the FAA have been notified and will be arriving on scene sometime today to begin their investigation.

    More than 125 people reported to the command post at 4400 S. Lecanto Hwy, Lecanto, during the April search.

    Jameis Winston and the Florida State Seminoles prevailed in a thrilling top five match up with Notre Dame in which the game came down to the final offensive play for the Irish.

    The game was all about one team answering another as neither team was able to score more than seven unanswered points against the other.

    Notre Dame is the last ranked team scheduled on Florida State’s schedule, so the win could possibly be the Seminoles last chance to impress the College Football playoff selection committee.

    Notre Dame was able to drive all the way down to the 2-yard line, a drive which included a 4th and 18 conversion. Notre Dame was able to reach the end zone on 4th down from the 2-yard line but offensive pass interference negated the play and set up a 4th and goal from the 18. The game finally ended on a Golson desperation pass to the end zone which was picked off by Pugh.
