    Denver Broncos head coach fired

The Denver Broncos and head coach John Fox are parting ways, executive vice president of football operations John Elway announced on Monday.

The wording of the reports, first from Fox Sports’ Jay Glazer and ESPN’s Adam Schefter, is that Fox and the Broncos decided to part ways. No matter how you put it, Fox is a free agent after meeting with Broncos general manager John Elway on Monday, and the Broncos need a new head coach. Maybe Fox wants to coach elsewhere (the San Francisco 49ers are already being speculated as a good fit), but it doesn’t happen unless the Broncos were ready to move on as well. After the Broncos lost their playoff opener to the Colts 24-13, apparently they felt a change was needed.

“While we have made significant progress under Coach Fox, there is still work to be done,” Elway said, via a team-released statement. “I believe this change at the head coaching position will be in the best interest of our long-term goal, which from day one has been to win World Championships.”

With Peyton Manning non-committal about his future, it seems like an end of an era for this core of players in Denver.

“I had a productive visit with John Elway this afternoon in which we were both very honest about our time together and how to best move forward,” Fox said. “After this discussion, John and I mutually agreed that the timing was right for this decision.

“Although we came up short of our ultimate goal, I am proud of our team’s many accomplishments during these last four years. I truly appreciate all of the hard work put in by every player, coach and staff member within this organization.

The move comes a day after the Broncos were eliminated from the playoffs by the Indianapolis Colts, and a year after the team’s first appearance in a Super Bowl since Elway, now the team’s general manager, retired as quarterback.

The team has 17 free agents, including star receiver Demaryius Thomas and tight end Julius Thomas. Defensive coordinator Jack Del Rio is the favorite for the Oakland Raiders’ coaching vacancy, according to ESPN Insider Adam Schefter and multiple reports, and offensive coordinator Adam Gase also has been linked to several job openings.

Fox posted a 46-18 record in four seasons with the Broncos. Before being named the head coach in Denver, Fox had a 73-71 record with the Carolina Panthers.

Fox noted that he’s eager to continue his coaching career and looks forward to the opportunities that lie ahead.

Broncos players said the firing of the coach caught them completely off guard.

Lakeland, Florida — Roy Knecht, 44, a Polk County deputy, along with his wife, Sheena Knecht, 32, were involved in a verbal argument after Roy stated he wanted to leave their house for good.

Sheena then pushed Roy on the couch, placed her legs over his, and grabbed him by the throat while yelling at him. She stated that she wanted to talk about their problems, but Roy refused.

According to reports, Sheena then got up from the couch, gathered Roy’s things, and threw them on the floor.

Sheena then grabbed Roy by a chain he wore around his neck and caused it to break.

Roy then approached Sheena and struck her on the chin with an open hand. He then placed his thumb under Sheena’s chin, pushing her head upward.

Roy continued to apply force to the pressure point as he took his free hand and placed it around her throat. Sheena told deputies that during that time, she could not breathe.

According to reports, Roy eventually removed his had from her throat and exited the residence.

Roy Knecht was hired as a deputy sheriff with the Polk County Sheriff’s Office in 1998. His current salary is $52,749. He was been placed on administrative leave pending an internal investigation.

The husband and wife were booked into the Polk County jail.

Ocala, Florida — A woman that was arrested in July 2014 for kicking a deputy in the face is back in the news. This time, she brought a friend.

Deputies responded to the Walmart located at 2600 Southwest 19th Avenue Road, Ocala, in response to a grand theft.

According to reports, Stephanie L. Ramos, 22, and Rebecca G. Parmer, 21, had placed merchandise in shopping carts and was making their way through the parking lot when some merchandise fell out of one of the carts. An employee of the store saw the merchandise fall out and alerted Ramos and Parmer. The employee stated that the two did not seem to care they had dropped — what she thought — was purchased merchandise.

According to deputies, Ramos and Parmer then re-entered the Walmart store. Once inside, the observant employee from the parking lot said the duo began filling shopping bags with stolen merchandise.

As they left the store with the merchandise, a loss prevention officer attempted to stop them. However, Ramos and Parmer fled the area, leaving the merchandise behind.

Surveillance video showed the thieves removing filing drawers, towels, rugs, mirrors, and other various items from the store. The video also showed that the duo left and re-entered the store multiple times.

Both women were arrested and charged with Grand Theft.

Parmer was arrested in March 2012 and charged with Lewd and Lascivious Battery on a Victim Under 16 and again in June 2012 on theft charges.

According to reports, Ramos is a known drug user and might have been stealing merchandise to sell or trade for drugs.

Ocala, Florida — Edwin R. Bermudez, 37, will remain behind bars following his January 7, arrest.

According to reports, on January 7, Ocala police met with a 15-year-old victim who stated Bermudez, a convicted sex predator, had moved into her home in October 2014 and began a sexual relationship with her mother. The victim believes that her mother knew Bermudez was a sex predator when she began a relationship with him.

The victim told police that on several occasions Bermudez told her he liked to “suck on girls privates” and told the victim he would like to perform oral sex on her.

The victim stated that on January 2, both of her siblings were outside playing when Bermudez arrived at her house with breakfast. The victim told police that Bermudez began to “sweet talk” her and told her that he could not wait until she turned 18.

    Deputy Brant Lickiss

Deltona, Florida – A Volusia County sheriff deputy’s first day on the job turned out to be a blessing for one Florida mother.

At approximately 4:30 p.m., Saturday, Deputy Brant Lickiss, during his very first shift, was at a traffic light near Normandy Boulevard.

Deputy Lickiss said [that] is when he saw a woman frantically pull into a driveway, jump out of her vehicle, and pull a small child from the back seat.

The woman then grabbed her own throat, signaling that her daughter, 4, was choking.

“The little girl was turning pale and appeared to be choking,” Volusia County Sheriff’s Office spokesman, Andrew Gant said. “Deputy Lickiss rushed to the driveway and began delivering strikes to the girl’s back.”

When Deputy Lickiss delivered the third strike to the girl’s back, a hard piece of red candy dislodged from the child’s airway and flew out of her mouth.

The girl’s mother didn’t speak English, but the deputy said he was able to understand what she was trying to say because she used her hands to communicate.

Paramedics were called out and cleared the girl on the scene.

“When I got up close to her daughter, her lips were starting to turn blue and she had her mouth wide open, like she was trying to get air,” Deputy Lickiss said.

Deputy Lickiss is now being called a hero.

Deputy Lickiss said, “I got into this line of work to help people and that was just part of my job, I saw someone in trouble and I just reacted.”

It was Deputy Lickiss’ first day unsupervised on the job.

Statement released: Dr. Asad Qamar, of the Institute for Cardiovascular Excellence PLLC (ICE), speaks out

    Dr. Asad Qamar

Ocala, Florida — Florida cardiologist, Dr. Asad Qamar, of the Institute for Cardiovascular Excellence PLLC (ICE), has released a video statement defending himself, and ICE, against two whistleblower lawsuits that have been filed.

In the video, he stated ICE is taking care of approximately 24, 000 patients in Northern Central Florida with various medical needs.

Qamar said, “Ice is the only cardiovascular practice in the entire area taking absolutely free care of our indigent, uninsured, and poorly insured patients.”

He goes on to say that Ice has the lowest amputation rate for peripheral arterial disease in the entire country.

Qamar says that ICE, out of 20,000 procedures, has a zero mortality rate.

U.S. Attorney A. Lee Bentley III for the Middle District of Florida, and Acting Assistant Attorney General Joyce R. Branda for the Justice Department’s Civil Division, are asking how ICE makes a profit, if it sees such a large quantity of patients for free.

According to the DOJ, Qamar billed more than $18 million, the second highest Medicare biller out of any physician in Florida for 2012.

Special Agent in Charge, Derrick L. Jackson, of the U.S. Department of Health and Human Services-Office of Inspector General (HHS-OIG), said, “We will continue to work with our law enforcement partners to protect beneficiaries and hold health care providers accountable for such outrageous fraud schemes.”

The DOJ, however, said the government stepped in over the law suits because of the amount of fraud that has been alleged, and the claims asserted by the government are allegations only. There has been no determination of liability at this point in the investigation.

    Walmart customer service employee arrested

    Yezenia Degross [Mugshot]
Ocala, Florida — A Walmart customer service employee was arrested after an investigation revealed she had been stealing from the Walmart located at 9570 SW Highway 200, Ocala.

A Walmart spokesperson said Yezenia Degross, 19, who works at the customer service desk, was making “fake refunds” and keeping the money.

A Walmart loss prevention officer, along with manager, Rebecca Peavey, discovered Degross would return items for customers then keep the receipt. After the customer would leave the store, Degross would ring up another return for a different item on the same receipt. She would then pocket the money.

Surveillance video and register transactions were combed through for days while the store gathered evidence — building a case against Degross.

Deputies said Degross stole $5,514.65 between November 26, 2014 and January 4, 2015.

She was booked into the Marion County Jail on charges of Grand Theft — more than $5,000.

She was later released on $2000 bond.

OPD: Ocala man wanted for murder, captured

    Dayomonte Mcintosh captured

Ocala, Florida — According to the Ocala Police Department, Dayomonte “Dayo” Osteen McIntosh was arrested in Albany, Georgia on Thursday.

The U.S Marshals Service Florida Regional Fugitive Task Force captured him at a relative’s home after OPD received a tip leading them to McIntosh’s location.

Detectives said McIntosh has not been cooperative at all and has provided little information.

McIntosh will be extradited back to Marion County, where he will face second-degree murder charges in the death of Jones, 23. Officials said the extradition could take days or weeks.

He is currently being held at the Dougherty County Jail in Georgia.

    (Original article)

A manhunt for a murderer is now underway in Ocala.

Last night, Ocala Police Department detectives received information that led to the identity of the suspect in the Monday morning shooting death of Antonio Jones, 23.

The shooter has been identified as Dayomonte Osteen McIntosh, 21. A warrant has been issued for his arrest for one count of Second Degree Murder.

Jones was gunned down in the Spring Manor Apartments parking lot Monday morning at approximately 8:30 a.m. He was murdered in the same area where another man was shot earlier this year.

In the July shooting, detectives found that the homicide was the result of an ongoing feud between two to three groups of young adults in Marion County that all had common interests — drugs and unnamed females — that placed them in the Spring Manor area at the time of the shooting.

    Tear it down

Residents of neighboring homes said they are fed up with the Section 8 apartments. “I pay for my rent, have a full time job, and work hard for what I have. Majority of the people that live in Spring Manor are unemployed and home all day doing God knows what,” said one single mom. “Frankly, I wish the entire place would burn down…or at least tear it down.”

One woman said if it were to be torn down, it would make a great public park.

Sources said that a nuisance abatement might be in the works.

A nuisance abatement, as a legal term, is a condition or use of a property that interferes with neighbors’ use or enjoyment of their property; endangers life, health, or safety; or is offensive to others. Because of the harm they do to others, Florida law authorizes local governments to use their police powers to compel the owners of nuisance properties to correct those conditions. If the owner fails to do so, the municipality can step in and correct, or abate, the conditions itself.

A nuisance abatement also applies to properties overridden with criminal activity, including high traffic drug and prostitution areas.

In some instances, judges have ordered properties (such as motels and apartment complexes) to cease operation.

According to authorities, neighborhood organizations and block groups need to understand the nuisance abatement laws, so that they can effectively press city government to take action and address nuisance conditions in their communities.

According to the Department of Housing and Urban Development, “It is the tenants that ‘make’ up a neighborhood. If you have bad tenants, you will most likely have a bad neighborhood.”

The same also applies to property managers they said.

    Security Footage

Detectives were able to obtain security footage in the Jones shooting. The footage showed at least 10 subjects standing around the area when Jones was shot. Detectives said it appeared that the group was involved some sort of disagreement prior to the shooting.

Multiple witnesses, who are not being identified out of fear of retaliation, said that the argument was over cooking pots. According to the arrest warrant, it also appears that a couple of females could have added fuel to the fire.

During the argument over the pots, McIntosh pulled out a .40 caliber handgun and pulled the trigger, but the gun jammed. Once McIntosh was able to clear the jam, he fired the weapon until the magazine was empty. Detectives found numerous empty .40 caliber shell casings at the scene.

Management for Spring Manor Apartments said neither Jones nor McIntosh lived in the complex.

Witnesses told detectives that Jones and McIntosh were in relationships with females who stay in the complex.

McIntosh fled the scene immediately following the shooting.

McIntosh has a criminal history and is considered armed and dangerous. He usually keeps a low hair cut and a clean shaven face. He is also missing a few teeth. McIntosh usually wears glasses, but might remove them to change his appearance. Detectives said he also goes by the street name “Dayo.”

Anyone with information is asked to call the Ocala Police Department at 352-369-7000. Girl releases video after French shooting, sparks controversy

Since the hate fueled shootings in Paris, many have turned to social media to express their anger, frustration, and sadness.

Words like #muslims, #CharlieHebdo, #cartoonist, and #freedomofspeech have been trendy on social media since the shooting.

And media outlets, such as the Associated Press and CNN, have come under fire for “bowing down” to the terrorists by removing anything that could be considered “offensive” to Muslims from their websites.

One Muslim by the name of Majed Abusalama, wrote, “I urge all Muslims not to apologize for the Paris shooting.” Others have made tasteless comments about New York and 9/11, citing it’s the city that never sleeps, until they (New Yorkers) meet Mohammed.

Cartoonists from all over have pulled together, drawing and posting cartoons in support for the lives that were lost. Many continuing to mock the Prophet Mohammed in order to show that they have the right to freedom of expression.

Rick McKee, a cartoonist for CagleCartoons.com, wrote, “In the aftermath of such cowardice, we in free Western societies have to ask ourselves: What kind of world are we going to live in? And will we allow these intolerant radical Islamic bullies to decide for us what we can read and what we can’t? As an editorial cartoonist working in a small Southern town in America, it might have been easy for me to feel insulated from attacks thousands of miles away. But we live in a global society, and this attack hit me on a very personal level.”

Some French residents have been captured on video calling for the eradication of Muslims in their neighborhoods.

But it’s a California girl by the name of Jaclyn Glenn that is getting a lot of attention. Approximately six hours ago, she released a YouTube video that has already sparked a lot of controversy.

She says the public should just call it what it is, and many seem to agree. She doesn’t hold much back in the video.

    Phoebe Jonchuck [Deceased]
St. Petersburg, Florida — Today, just after midnight, John Nicholas Jonchuck, 25, committed an unthinkable act. Jonchuck drove his vehicle over a Tampa Bay bridge and pulled over. He then removed his daughter, Phoebe, 5, from her seat by her arms, pressed her head to his chest, and threw her over the rail. Phoebe fell more than 60 feet into the water after being tossed over the Dick Misener Bridge, which leads into Sunshine Skyway bridge.

According to St. Petersburg Police, an officer, who was on his way home, saw Jonchuck speed by in his Chryslet PT Cruiser at 100 mph near the Bayway exit. The officer attempted to conduct a traffic stop; however, by the time the officer was able to catch up to the vehicle, Jonchuck had already pulled over to the side of the road.

The officer reported that Jonchuck jumped out of his vehicle and began to “rush” toward the officer. The officer drew his weapon, but Jonchuck went around to the passenger side of the car and got his daughter out.

The officer said Jonchuck mumbled something, but he couldn’t make out what Jonchuck had said.

That is when Jonchuck threw her over.

The officer said he thought he could hear the girl screaming as she fell.

The officer immediately ran to the side of the bridge in an attempt to locate the girl. He lowered a ladder to a platform so he could get closer to the water, at which time Jonchuck got back into his vehicle and fled the scene.

The Eckerd College Search and Rescue team found the girl nearly one mile from where she was thrown in the water. It took over an hour for rescue to locate the girl.

“Seeing that it is an deliberate act is kind of what sticks out,” said Ryan Dilkey, coordinator for Eckerd’s search team. “It is terribly unfortunate. It adds to the tragedy.”

Police said every effort was made to try and revive Phoebe, but she was pronounced dead at 3:20 a.m.

A friend of Jonchuck called police Tuesday night and reported some creepy text messages he had sent her. The messages were mean and he called her names she said. She said in one text message he wrote that he had found Jesus. She told police it was odd and out of the ordinary.

Police advised her to file a restraining order.

The Pinellas County Sheriff’s Office has released a 911 audio recording of Jonchuck’s attorney, Genevieve Torres. She placed the call on Wednesday, after she had met with him on a parental rights case. Torres is now completely devastated that she allowed Phoebe to leave her office. She said she knew something was wrong, she could “feel it in her gut.” On the audio, you can hear how upset Torres was for the child.

Deputies met up with Jonchuck at the church he mentioned, but they said everything seemed okay. And it didn’t appear the child was in any immediate danger.

Torres also called DCF, but they did nothing.

Court records show Jonchuck has been charged with domestic battery six times since 2008, but the charges were dropped in every case. He was also arrested for DUI in 2013. He sought a domestic violence injunction against Phoebe’s mother late last month, but his petition was denied.

Jonchuck was located in Manatee County, where he attempted to run over deputies with his vehicle. Stop sticks had to be deployed to stop him.

He was arrested and charged with First Degree Murder, Aggravated Assault with a Motor Vehicle on a Law Enforcement Officer, and Fleeing and Eluding.

According to the St. Petersburg Police Department, Jonchuck demanded an attorney and refuses to cooperate with police.

    Michelle Kerr, Phoebe's Mother
    Michelle Kerr, Phoebe’s Mother

Phoebe’s mother, Michelle Kerr, told police that Jonchuck is bipolar, but she always considered him a good father. However, she did tell police Jonchuck, at times, could be like “Jekyll and Hyde, a demon, a devil.”

Jonchuck had custody of Phoebe at the time of her death.

Police said Kerr gave custody of Phoebe to Jonchuck because Kerr didn’t feel she could take care of the child any longer. Kerr has two more children at home.

Kerr has also been arrested multiple times for Fraud, Theft, and in 2008 she was arrested for Felony Child Neglect.

Kerr now says she completely forgives Jonchuck for what he did.

St. Petersburg Police Chief, Tony Holloway, said even though the officer thought he heard the girl scream, an autopsy will be performed so they can determine if she was already dead when she was thrown over the railing.

“I’ve been doing this job for 29 years,” Holloway said. “I don’t even know what was going through this guy’s mind.”

Police fanned out across France in search of three hooded gunmen who attacked employees of the satirical magazine, Charlie Hebdo, Wednesday, and killed 12 people before escaping onto the streets of Paris.

“Everything will be done to arrest (the attackers),” French President Francois Hollande said in a speech Wednesday night. “We also have to protect all public places. Security forces will be deployed everywhere there can be a threat.”

The French magazine targeted by gunmen who killed journalists and police in a brazen lunchtime attack is no stranger to controversy. In 2011, the office of the magazine was badly damaged by a firebomb after it published a spoof issue “guest edited” by the Prophet Muhammad to salute the victory of an Islamist party in Tunisian elections. It had announced plans to publish a special issue renamed “Charia Hebdo,” a play on the word in French for Shariah law.

In today’s attack, the dead included Georges Wolinski, who worked under the pen name Wolinski, Jean “Cabu” Cabut, Bernard “Tignous” Verlhac, and Philippe Honore, known as Honore — ranked among the most popular and best-known members of a provocative staff whose cartoons of the Prophet Mohammed in recent years angered some Muslims.

In a 2012 interview, Charlie Hebdo magazine editor, Stephane “Charb” Charbonnier, said the magazine only faced problems when Muslims were mentioned. He said that was a problem.

Charbonnier was killed when hooded attackers carrying assault rifles burst in and shouted “Allahu Akbar,” Arabic for “God is great,” as they opened fire.

The terrorist attack by masked gunmen on the newspaper, left 12 people dead — including the top editor, prominent cartoonists, and police officers — and was among the deadliest in postwar France.

Officials said at least two gunmen carried out the attack with automatic weapons with an unusual degree of military-style precision. They also said the gunmen called out the name of each victim before they were shot.

French police characterized this attach as a “slaughter.”

Charbonnier, once famously said, “I’d rather die standing than on my knees.” He also said, in the face of animosity from extremists, “I live under French law, not Koranic law.”

Honda Accord pulled from the St. Johns River

Orange City, Florida — The Volusia County Sheriff’s Office is investigating after the body of an adult female was found in a vehicle submerged in the St. Johns River near Blue Spring State Park.

The Sheriff’s Office received a call from a boat captain around 10:50 a.m., who reported a kayaker had seen a vehicle in the water near a boat ramp at the end of French Avenue in Orange City.

Responding deputies recovered the vehicle a short time later and confirmed a body was inside. She has been identified as Kathy Marie Hilbert, 57, of Daytona Beach.

Hilbert’s son had requested a well-being check on Hilbert on January 6. Daytona Beach Police responded and ultimately put out a countywide BOLO (Be on the lookout) for Hilbert.

Her son told authorities that his mother was a recovering alcoholic and had been sober for a month, but recently started drinking again.

“I don’t know what went wrong,” said Hilbert’s boyfriend of 16-years, Jim Butzin. “I really don’t. She deserved a better life than she had. She was a wonderful woman.”

Volusia County Sheriff’s Office Public Information Officer, Gary Davidson, said they do not suspect foul play at this time. However, Hilbert’s son said his mother has attempted suicide in the past.

The official cause and manner of death will be determined by the medical examiner’s office.

    Damien Kornegay, 16 — Deceased

White Springs, Florida — Additional information is now available in the murder of a 16-year-old boy in Columbia County, Florida.

Detectives with the Columbia County Sheriff’s Office determined that Nicole Kornegay, 11, assisted her sister, Misty “Ariel” Renee Kornegay, 15, in the murder of their 16-year-old brother, Damien Kornegay, and both teens have been arrested and charged with Premeditated Murder.

On Monday, January 5, at approximately 10:00 p.m., Columbia County Sheriff’s Office deputies were dispatched to 1205 Sophie Dr. in reference to a report of a person being shot. Once on scene, deputies discovered that a 16-year-old male had been shot to death in the living room.

The investigation was initiated when a White Springs Police Officer contacted Columbia County Dispatch after encountering the two female juveniles in the city of White Springs. While talking with the juveniles, they informed him of a shooting at their residence. Officers Brad Meeks and Joseph Dyes said that the 15-year-old stated, “There might be something wrong my brother at home.”

White Springs police said they began looking for the girls late Monday night after a friend of the family had received a “weird phone call” from the 11-year-old. The friend stated that the girl said she had run away and needed someone to pick her up from a Dollar General store. When the woman arrived, she found the 15-year-old sister there, too.

Police said as they were speaking with the 15-year-old she was applying makeup and showed no emotion. According to reports, she would not make eye contact with police while speaking with them.

Eventually, police said, she began crying and stated that her brother had beaten her, thrown her into her bedroom, and locked the door. When her brother fell asleep, the younger sister let her out. That’s when the teen said she grabbed a gun from her parents’ room and shot her brother. According to reports, the bedroom was locked at the time the teen retrieved the gun.

The 15-year-old was arrested and taken to the Columbia County Detention Facility where she was booked on one count of Premeditated Murder. The 11-year-old was also arrested and charged with Premeditated Murder. She is now the youngest person in Florida to be arrested and charged with murder. One of the sisters is being held at a detention facility in Ocala.

The parents, Keith Kornegay, 37, and Misty Kornegay, 33, were also arrested and charged with Child Neglect for failing to properly supervise their children. Detectives also said the parents of the 15-year-old would lock her in her room with only a blanket, and a bucket to use the bathroom in.

Detectives said the mobile home the family lived in was filthy.

The parents of the children were out of town at the time of the shooting. The dad, who was a truck driver, often left his 16-year-old son in charge of the other children while he and his wife were on the road.

A 3-year-old girl was also removed from the residence and is now in state custody.

Both sisters are being held without bond.

The Columbia County Sheriff’s Office said they are ensuring counselors are available for the sisters.

DUI checkpoint: Don’t roll down your window?

Levy County — Many drivers have encountered a DUI checkpoint, and one video, shot in Levy County, Florida, is telling drivers they don’t even have to open their window to roll right through.

The video has many asking if it is exercising your rights or keeping drunk drivers from being caught?

Attorneys say some law enforcement officers have arrested Florida residents for refusing to roll down their window, some even breaking the window. But refusing to roll down your window is legal in Florida and law enforcement officials cannot arrest you for refusing, or break the window during a DUI checkpoint.

On New Year’s Eve, just before 10 p.m. in Levy County, Florida, Jason Gray knew he was about to hit a DUI checkpoint.

“This is my Fair DUI flier,” he said while recording the video. “You can see it has Fair DUI flier language. ‘I remain silent, no searches, I want my attorney.’ ”

Inside the plastic bag that he hangs from the closed driver’s side window is all the identification a law enforcement official will need need: License, registration, and insurance. The flier also cites two Florida statutes attorneys say are very important for Floridians.

“I will not have to open my window,” Gray said, “because the second you open your window, they can say they smell alcohol or drugs in the vehicle and the moment you say a word, they can claim your speech is slurred.”

In the video, as Gray pulled up to the checkpoint, deputies shined a light on the note, took a few seconds to study it, then sent him on his way. One of them waved, and stated, “have a nice day.”

The video has gotten more than a million views since January 1, and to no surprise, has stirred up massive controversy.

“The intention is not to give the drunks a get-out-of-jail free card. A lot of people are uncomfortable with the idea that police can just stop you for no reason. If you are not comfortable with that, this is a good way of handling a checkpoint,” FairDui.org founder and author, Warren Redlich, said. “There are good cops and there are bad cops. The purpose of this flier is to protect innocent people from bad cops.”

Redlich said in the handful of times they have used the card, it has never failed.

Florida Highway Patrol Spokesperson Sgt. Steve Gaskins, said, “The intent of DUI checkpoints is never to violate anyone’s rights. They are to manage traffic and pull drunk drivers off the road, potentially saving the driver or someone else’s life.”

According to legal analysts with FairDui.org, law enforcement officials cannot legally pull a person over without a reason, but they can legally follow a person if they suspect DUI in order to observe a person’s driving pattern.

Attorneys said displaying the sign is legal, but it cannot block a driver’s face from the view of an officer. Attorneys also say displaying the sign could draw unnecessary attention to a person.

Tampa DUI defense attorney, Elliott Wilcox, said, “It’s legal, but you draw attention to yourself. If you draw attention to yourself, you better be squeaky clean going through a checkpoint. Because otherwise, you give them another reason to pay attention to you. If you are not squeaky clean, that could be the worst thing that happens to you.”

On the bottom of a Florida driver license it reads, “Operation of a motor vehicle constitutes consent to any sobriety test required by law.” However, attorneys said being stopped at a DUI checkpoint is not the same thing as a sobriety test.

    Stephanie Jones [Mugshot]
Marion oaks — Marion County Sheriff’s Deputies located and arrested Stephanie Jones, 23, after she fled from a traffic stop on December 28, 2014.

According to reports, while patrolling the Marion Oaks area, Deputy Tanya Rodriguez saw a silver four-door vehicle at the intersection of SW 35th Court Road and Marion Oaks Manor with two young children in the vehicle not wearing proper restraints.

Both children, ages two (2) and six (6) were standing up in the front seat of the vehicle.

Deputy Rodriguez immediately initiated a traffic stop on the vehicle to avoid potential injury to the children.

Jones advised Deputy Rodriguez that [she] did not have car seats for the children. Jones was attempting to transport the children from Marion Oaks to the Silver Springs Shores area without any type of child restraints.

A vehicle check revealed a Florida Authorities Seize Tag notification for the vehicle, which was registered to Jones’ brother, Jermaine L. Barr.

According to reports, when Deputy Rodriguez notified Jones that she had to seize the tag of the vehicle, [she] began yelling, demanding the deputy provide proof that she was required to seize the tag. The deputy then informed Jones she was not required to provide proof and that she would be arrested if she did not allow the deputy to remove the tag from the vehicle.

With that, Jones snatched her license from the deputy and took off at a high rate of speed. At that point, the children were still not properly restrained.

Jones continued at a high rate of speed, causing the deputy to lose sight of Jones’ vehicle. Deputies searched the area, but were unable to locate Jones. Attempts to reach Jones at her home address were also unsuccessful.

On December 31, 2014, Deputy Rodriguez obtained a warrant for Jones’ arrest.

On January 2, Jones was arrested and transported to the Marion county Jail.

She was charged with Fleeing and Eluding Law Enforcement, Obstruction, and Felony child Abuse.

Jones was released on $8,000 bond.

Jones has previous arrests for Battery and Fraud.
