Ocala, Florida — New trouble for Churchill Pediatric Dentistry, formerly Polliwog Dental, owner Rebecca Tarver and former Polliwog Dental owner Michael Tarver.

In late October, two former employees that were fired by the pediatric dentists in retaliation for cooperating with DOH, filed a lawsuit against Polliwog Dental, LLC. The complaint is for violating the Whistleblower Act as well as unpaid wages owed to the two employees.

Andrea Frederick and Tiffany Sullivan are the two plaintiffs in the lawsuit.

The lawsuit states that Michael Tarver was recorded via a cell phone while he remotely logged into the medical database and illegally altered medical records that were requested by DOH during their investigation. Frederick also used her cell phone to record Michael Tarver’s computer activity.

Medical and billing information on patients were also printed in fear that Tarver would alter the billing information to conceal evidence from DOH investigators. Michael Tarver did, in fact, alter the records after they were copied, those records were used as evidence.

During the investigation, Tarver ordered Sullivan to “stall” investigators, specifically Investigator Mike Knezvich. The lawsuit comes after Tarver’s attorney, Edwin A. Bayo´,of whom used to provide advice and representation to regulatory boards under the umbrella of the Department of Health and assisted Tarver in having his dental license reinstated, blasted Knezvich; alleging the accusations that Tarver altered records was absurd and that the charges were fraudulent.

In the lawsuit, Sullivan states that she was ordered by Tarver to refuse DOH investigator Knezvich any documents that were subpoenaed.

According to the complaint, the two women stated that both Rebecca Tarver and Michael Tarver questioned employees about the DOH investigation on multiple occasions. Consequently firing two of the employees now known as Sullivan and Frederick, after the Tarver’s learned they cooperated with DOH; therefore the Tarver’s violated the Whistleblower Act.

The complaint also states that both employees refused to participate in the altering of any medical records which also contributed to their termination.

Frederick and Sullivan were told by Knezvich that the two did not have to answer any questions asked of them by the Tarver’s in regards to the investigation.

The Tarver’s have claimed innocence since the Polliwog fiasco started, and Despite video evidence against Michael Tarver, he was able to have his license reinstated with the help of his attorney, who as previously stated, has done consulting for regulatory boards.

Michael Tarver is not the registered owner of Churchill Dentistry. A quick search of “Churchill Dentistry” revealed it is registered to a Wendy Churchill. However, Ocala Post realized that “Churchill Dentistry” has been registered since 2001. Further investigation revealed that the actual registered name of the former Polliwog Pediatric Dentistry is CHURCHILL PEDIATRIC DENTISTRY, LLC., registered to Michael Tarver’s wife, Rebecca Tarver. Wendy Churchill is not associated with the Tarver’s.

Churchill Dentistry’s parking lot was empty today.

    Protection From Food Poisoning

    0

ocala post, op, ocala, ocala news, doh, food poisoning
Food Poisoning happens to thousands of people every holiday season.

Tallahassee, Florida — This holiday season, the Florida Department of Health (DOH) encourages Floridians to properly prepare meals and store food in order to prevent foodborne-illness or diseases caused by eating contaminated foods and drinks.

“Preventing foodborne-illness is important to keep your family safe and healthy during the holidays and year round,” said Jamie DeMent, the Department’s Coordinator of the Food and Waterborne Disease Program. “Floridians should practice four simple steps to stay healthy while cooking this holiday season–clean, cook, chill, and separate.”

An easy way to prevent foodborne-illness is to maintain a clean and tidy kitchen. Insist that any helping hands in the kitchen this holiday season are cleaned thoroughly and often. Wash any objects that are in contact with raw poultry – including hands, cutting boards, knives, etc. — in hot, soapy water. Also, be sure that all uncooked meat and poultry are prepared individually and separated from vegetables and cooked food. Keep all countertop and work areas clean with disinfectant spray. Those who experienced a gastrointestinal illness during the past two weeks should refrain from preparing meals for others.

Planning ahead to ensure that you have enough time to fully prepare and cook a turkey is crucial. A frozen turkey needs 24 hours to thaw for every five pounds of bird. Therefore, a 10 lb. turkey will require two days of premium thawing time before serving. Thawing your turkey in the fridge reduces the risk of foodborne-illnesses from bacteria, which multiply rapidly at room temperature or in warm environments. Stuffing your turkey prior to cooking it allows raw poultry juices to absorb into the stuffing, causing improper cooking of the turkey to occur. Be sure to thoroughly cook the turkey at 325 degrees. The turkey’s internal temperature should stay at 180 degrees, as any temperature below this can result in bacterial growth.

Experts say you should refrigerate leftovers within two hours of preparation. Leaving food out too long creates a prime breeding ground for bacterial growth. When storing your leftovers, separate raw meats, poultry, eggs and seafood into their own containers. Never leave food on the table and insist on heating up leftovers to their proper temperature of 165 degrees. Be sure to throw away food that is cloudy or mushy or food with an unusual odor. Also dispose of food that is from a leaking can or food that changes appearance, color and/or shape over a period of time.

For more information on how to keep your family safe from foodborne-illness this holiday season please visit http://www.cdc.gov/foodsafety/, http://www.fsis.usda.gov/ and http://www.fda.gov/Food/default.htm. If you experience a foodborne-illness please report it to your local county health department or file an online complaint at http://www.floridahealth.gov/diseases-and-conditions/food-and-waterborne-disease/online-food-complaint-form.html

    Mexican Investor Ernesto Garcia Deported

Ernesto Karam-Garcia [Photo Taken and Provided by ICE]
San Antonio, Texas — A Mexican national, who is wanted for defrauding hundreds of Mexican citizens of their earnings, was deported and turned over to Mexican law enforcement authorities Thursday by officers with U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO).

Ernesto Karam-Garcia, 45, entered the United States with an Investor Visa in August 2011. On November 29, 2011, Mexico’s 39th District federal court issued an arrest warrant for Karam-Garcia charging him with fraud. Karam-Garcia was arrested August 21, 2013 at his San Antonio residence by the U.S. Marshals Service (USMS) Long Star Fugitive Task. After his arrest he was turned over to ICE, where he remained in custody until his removal November 21, 2013.

According to Mexico’s Procuraduría General de la República (PGR), Karam-Garcia and two other associates allegedly defrauded several hundred Mexican citizens of their earnings, totaling more than $150 million in U.S. currency. ICE officers worked with Mexican authorities to identify that Karam-Garcia was wanted for fraud in Mexico. The PGR assisted ICE by providing copies of the warrant and helped coordinate the removal at the U.S./Mexico International Border at Laredo, Texas.

This individual thought he could evade justice in Mexico by hiding in the United States,” said Enrique M. Lucero, field office director for ERO San Antonio. “As this case makes clear, ICE works closely with law enforcement agencies here and abroad to ensure convicted criminals are returned to their home countries in order to be held accountable for their actions.”

“This was a proud day not only for the law enforcement agencies involved in the apprehension and deportation of Karam-Garcia, but most importantly for the victims who suffered economically and sought justice,” said U.S. Marshal for the Western District of Texas Robert R. Almonte.

This removal is a result of the expanded binational cooperation to identify arrest and repatriate Mexican fugitives who have fled to the United States to avoid prosecution. Homeland Security Investigations (HSI) Mexico works closely with the Mexican government as part of this effort. Many of the captured fugitives are charged with homicide or other violent crimes in Mexico.

Ernesto Karam-Garcia, ocala, ocala news, op, ocala post
Ernesto Karam-Garcia being put on a plane for deportation.

Since Oct. 1, 2009, ERO has removed more than 645 foreign fugitives from the United States who were wanted in their native countries for serious crimes, including kidnapping, rape and murder. ERO works with the HSI Office of International Affairs, foreign consular offices in the United States and Interpol to identify foreign fugitives illegally present in the country.

ERO is focused on smart, effective immigration enforcement that targets serious criminal aliens who present the greatest risk to the security of our communities, such as those charged with or convicted of homicide, rape, robbery, kidnapping, major drug offenses and threats to national security. ERO also prioritizes the arrest and removal of those who game the immigration system, including immigration fugitives or those criminal aliens who have been previously deported and illegally re-entered the country.

    Marion County Crime Rate Down

Marion County Florida — The Florida Department of Law Enforcement released the 2013 mid-year crime statistics for the state, showing that Florida has a lower crime rate by 5.2%, while Marion County’s crime rate has dropped 8.5%.

In the State of Florida, FDLE monitors reported Part 1 crimes and the clearance rate of those crimes. The seven Part 1 crimes closely monitored by the state are murder, rape, robbery, aggravated assault, burglary, larceny, and auto theft.

The Marion County Sheriff’s Office has one of the highest clearance rates and lowest law enforcement cost per capita in the unincorporated areas. The Marion County Jail continues to have the lowest cost per day to house inmates.

In 2013, the FDLE crime report shows that crime overall is down in Marion County, however, murder is up from 7 in 2012 to 11 in 2013, as well as robbery. It also indicates that 50.3% of Part 1 crimes, such as murder, rape, robbery, burglary and thefts were closed by Marion County Detectives for 2013.

Over the last 11 months, Sheriff Blair has contributed to this low crime rate by instituting a new Crime Suppression Division which targets street level crimes. He also reduced administrative positions and added deputies: “More boots on the ground”. This proactive stance on crime has made Marion County a safer place to live, according to the Sheriff’s Office.

Commissioners allow liquor store after residents said no

    2

Church and Liquor Store ocala, ocala, ocala news, opOcala, Florida — County land regulations forbid retail liquor sales within 500 feet of a church, school, and public parks, unless, of course the store-owner is granted an exception by County Commissioners.

State zoning laws also prohibit liquor stores from being built near churches, schools, and playgrounds.

Recently County Commissioners did in fact grant an exception, breaking the county’s own regulations by permitting a liquor store to be built near the Good News Church.

Residents fear the liquor store will bring an undesirable crowd to the neighborhood.

Marion County Commissioners claim the liquor store will not be a nuisance to surrounding residents. However, statistics show that when there is a liquor store close to a residential area, there is more likely to be crime, loitering, and drunk drivers. According to experts, drunk driving does not only apply to patrons that leave bars after a night of drinking, but also people who drive to a liquor store already intoxicated. Additionally, two million liquor stores are robbed every year in the U.S.

Residents voiced their opinions to the BCC, however, Commissioners gave the go ahead anyway.

One resident said, “What is the point of speaking if the Commission breaks the law and passes a permit to have a liquor store built near a church that could potentially endanger children.”

Ocala Post found that childcare is provided for infants and toddlers at Good News Church during sermons. For young children (Pre-K to 5th Grade) there is a 30 – 40 minute program that meets during the sermon portion of a service, and there is a youth bible study for middle school and high school students that meets Tuesday nights at 6 p.m.

We want to hear from you. Do you think the BCC went too far?

    Florida Congressman Trey Radel Guilty

Florida Congressman Trey Radel , ocala, ocala post, op, ocala news
    Florida Congressman Trey Radel

Florida – DEA and other federal officials announced that U.S. Rep. Trey Radel, 37, pled guilty yesterday in the Superior Court of the District of Columbia to a misdemeanor charge of possession of cocaine.

Radel, who represents the 19th Congressional District of Florida, appeared before the Honorable Senior Judge Robert S. Tignor. As a first-time offender, Radel was able to ask the Court, under District of Columbia law, to defer entering a judgment of guilty and place him on probation. Judge Tignor placed Radel on one year of probation. If the probation is successfully completed, the Court could then dismiss the case without an adjudication of guilt.

According to a statement of offense submitted as part of the plea, Radel came to the attention of the FBI and DEA in the fall of 2013, during an investigation into cocaine trafficking in the Washington, D.C. metropolitan area. Agents learned that Radel would purchase cocaine for his personal use and sometimes share it with others.

The statement of offense says that, on Oct. 29, 2013, Radel met with an undercover police officer at a restaurant in the Dupont Circle area of Washington, D.C. At this time, Radel agreed to buy about 3.5 grams of cocaine from the undercover officer. He and the undercover officer went outside, and Radel handed over $260. The undercover officer provided Radel with a package of cocaine. Federal agents then approached Radel and the cocaine was recovered.

Radel agreed to speak with the agents about what had taken place and invited them to his apartment. There, he voluntarily admitted that he had purchased the cocaine. He also retrieved and provided to the agents a vial of cocaine that he had in his apartment.

Drug traffickers and abusers respect no boundaries or limits and our neighborhoods and communities often pay the price,” said DEA Special Agent in Charge Karl Colder. Adding, “DEA and our law enforcement partners will continue to relentlessly pursue these drug trafficking networks and their criminal associates at every level. They pose a direct threat to the safety and security of our community here in the D.C. metro area. We want young people to see the price people pay for drug abuse and trafficking in cases like this so they will resolve to live drug-free lives.”

“Today’s guilty plea emerges from a broader narcotics investigation that brought to light information that a sitting Member of Congress was routinely using and buying cocaine. Once this information was confirmed, law enforcement could not ignore this illegal conduct,” said U.S. Attorney Ronald Machen. Adding, “Mr. Radel’s guilty plea is similar to those entered every year by hundreds of other drug offenders in the District of Columbia who possess illegal narcotics. We appreciate his willingness to promptly accept responsibility for his conduct.”

Today’s announcement demonstrates that illegal drugs continue to be present in our communities, and do not discriminate by age, gender, socio-economic group or profession. Along with our law enforcement partners at the DEA, the FBI remains focused on stopping the movement and sale of drugs on our neighborhood streets,”said FBI Assistant Director in Charge Valerie Parlave.

In announcing the plea, U.S. Attorney Machen, Assistant Director in Charge Parlave, and Special Agent in Charge Colder commended the work of those who investigated the case. They also expressed appreciation for the work of the Fairfax County, Va., Police Department and the U.S. Attorney’s Office for the Eastern District of Virginia. Finally, they commended those who handled the case from the U.S. Attorney’s Office, including Assistant U.S. Attorney Nihar R. Mohanty, who is prosecuting the matter.

It is unknown at this time if the individuals Radel shared the cocaine with were members of Congress.

Polk County, Florida — Two juveniles that were previously charged in the suicide death of Rebecca Sedwick have had the charges dropped. Attorney Jose Baez, the attorney that represented alleged murderer Casey Anthony also represented the youngest of the teens in the Sedwick case.

Attorney Baez fired off at Sheriff Grady Judd for releasing information and photos on the two juveniles that were previously charged as felons. Sheriff Judd fired back by saying, “As an attorney you should know the public record law, if you are charged with a felony, it is public record when you are a juvenile.” Adding, “A lot of what Attorney Baez said was bluster, and does not deserve a response.”

Sheriff Grady Judd said, “Let’s not lose sight of the fact that a 12-year-old girl is dead as the result of bullying.”

Rebecca Sedwick was only 12 when she jumped to her death following months of being battered and bullied by the two juveniles. The youngest of the two juveniles have shown remorse, said Judd. “Hopefully the oldest bully will get the counseling she needs and go on to be a productive member of society in her later years,” he added.

The family of Rebecca Sedwick is greatly disappointed in the outcome of this case and the public is outraged with the State Attorney’s Office as well as Jose Baez.

The oldest teens mom, Vivian Vosburg, 30, of 3143 Crystal Hills was arrested after a brutal video of her beating other children surfaced in October of 2013.

Both teens are said to be receiving counseling at this time.

Ocala, Florida — Detective Jorge Fernandez and fellow detectives from the Ocala Police Department have been continuing to investigate the homicide of Samuel Washington, which occurred on November 14, 2013.

In the course of their investigation they have been able to link the homicide of Washington, to the shooting of Michael Drayton, that occurred on November 7, 2013.

There are two groups that have been having on-going issues with one another. One group originates from the area of the Silver Springs Shores and the other is from the area of Parkside Gardens Apartments.

Both shootings also originated with conflicts that occurred at the club Cloud 9 just prior to the shootings.

Drayton, who is associated with the group out of Silver Springs Shores, was shot as a result of a conflict between the two groups that occurred at Cloud 9 the evening of November 6, 2013.

The shooting homicide of Washington, who was associated with the group from the Parkside Gardens area, is said to have been a retaliation by the group from the Silver Springs Shores area for the shooting of Drayton.

Detective Jamie Buchbinder continues to investigate the shooting of Drayton.

Detective Fernandez has arrested two persons for crimes in relation to the homicide: Howard Lee Hill, and Laquan Ria’Mel Barrow, were both arrested for one count each of Burglary of a Conveyance with a Battery. Detective Fernandez has now obtained warrants for two black male suspects for charges relating to the homicide: Tydree Najee Barrow and Gerod McFero Rawls. The charges on the warrants are for four counts each of Aggravated Assault with a Firearm and and count each of Throwing Deadly Missiles into an Occuppied Vehicle. The shooters in each of the incidents have not yet been identified.

Convicted Felon, Gerod Rawls, may have ties to Volusia County. Rawls has been arrested two separate times: once in 2011 and again in 2012, both arrests were for Trafficking Cocaine.

Currently there isn’t any information available on Tydree Barrow, however he is believed to be in the Ocala area.

Residents in the areas of Silver Springs Shores and Parkside Apartments should be on the lookout for the two suspects. If you see something, say something.

Anyone with further information on either, or both, of these cases is asked to contact either Det. Jamie Buchbinder at 352-369-7141 or Det. Jorge Fernandez at 352-369-7145, or to submit tips through the OPD mobile app, MyPD, in which the tipster has the option to remain anonymous. Body Exhumed For Cold Case File In Volusia County, Florida

Volusia County, Florida — A Volusia County cold case homicide has remained stubbornly unsolved for four decades. Few, if any, useful clues have survived the passing years. Today’s investigators don’t even have a name to label the thin case folders. John Doe, 1972, has to suffice. All the evidence that could possibly move the case a step forward has been buried with the victim in a plot on the far edge of a Daytona Beach cemetery. But on a cold and blustery November day the search for John Doe’s real name and the hunt for his killer got a fresh start. The first exhumation order requested by the Sheriff’s Office in about 15 years allowed determined investigators to open the victim’s grave in search of locked away secrets. It was time to meet John Doe.

In early 1972, President Richard Nixon visited China, a gallon of gas cost about 30 cents, and the sitcom All in the Family was one of the most popular shows on television. But for one young man, 1972 was the year his short life ended. His body was found May 3 in a pond near Indian Lake Road, Daytona Beach. The victim had been stabbed several times. Investigators did what they could to learn the victim’s identity, including removing his fingers and shipping the preserved digits to an FBI lab for fingerprint analysis, which was standard practice in such cases at the time.

Today there are no surviving documents related to the fingerprints or any other identification attempts. With little to work with, Cold Case Unit investigators took the rare step of requesting that a judge approve an order to exhume the victim’s remains from his grave at Cedar Hill Cemetery. Investigators were assisted by Victor Lohman and Scott Seegert from Lohman Funeral Homes who located the burial records and then participated in the exhumation. Investigators also asked for help from the C.A. Pound Human Identification Laboratory at the University of Florida. Director Dr. Michael Warren agreed to work with the Volusia County Medical Examiner’s Office in the exhumation and subsequent analysis of the remains. With all the pieces of the new investigation coming together, the date of November 13, 2013 was set for the exhumation.

Dr. Warren and a few of his eager graduate students got started early Wednesday morning and spent several hours digging into the sandy Florida soil. Crime scene investigators from the Volusia County Sheriff’s Office, Volusia County Medical Examiner’s Office and other local agencies were on hand to assist and learn. Dr. Rick Snow, who came from Atlanta as a representative of the National Center for Missing & Exploited Children, also was on hand to help. The first objects encountered a few feet down were several small jars. Many were broken, but at least one still contained a preserved severed finger that had been returned by the FBI and buried in the grave. Dr. Warren and his students did most of the excavation work, especially when the collapsed burial container was uncovered. It took a lot of careful chipping away at the rusted metal to finally reveal the victim, still enveloped in a rubber body bag. Once the bag was finally pried free of its surroundings, the graduate students lifted it out to the surface.

The bag was opened and the forensic anthropologists and Cold Case investigators got their first look at the victim. Evidence of his wounds was still apparent to the trained eye. Dr. Warren also made the first new discovery: the victim may have been younger than originally thought. It was believed that the victim was in his late teens or early twenties. However, Dr. Warren saw evidence that the victim may have actually been in his early teens, but his observations will be verified during a more thorough examination at a later date.

The remains were then sealed in a new body bag and transported to the C.A. Pound Laboratory to be stored. It’s hoped that DNA that will be extracted from the remains can shed some light on this old case. The DNA work will be done by the University of North Texas, which participates in the President’s DNA Initiative. Also, the C.A. Pound Laboratory will do a CT scan of the victim’s skull. That scan will then be given to the National Center for Missing & Exploited Children’s Forensic Imaging Unit where a facial reconstruction will be done. It will likely take a few months to complete all of this work. Nonetheless, John Doe’s decades-old secrets are finally on their way to being revealed.
